To be frank I think there seems to be this assumption everyone should know that "Tevin is a lone wolf and does not do other people's streams" and he did not like "Rekieta Fanboys Harassing" or something like that. His chat called Nick "Entitled" and such. Nick wanted to see if Tevin wanted in and as his agent on the matter, I tried to confirm this instead of going "Yeah sorry boss the Twitter says Tevin does not want to" and I don't personally follow Tevin close enough to know if it was that obvious.
This is something I hope to have Nick address via the reaction to videos / tweets / forum posts by Phil where he explains the law. Hell, DSP & Law is one of my favorite topics.
What a weird way to interact with dsp streamers. Makes me more curious as too why that is. Getting hostile to that is just an odd one to me. Oh well. Thanks for the info.
My concerns are listed here. I'm sure Nick will be informed about all of these but I wanted to write them down to be sure.
- Dark claimed in the creditor meeting that his Nintendo Switch was a business asset that he uses only for business. He later admitted while not under oath that its actually a personal asset that was gifted to him by an idiot and that his wife Kathy uses it more than he does.
- Dark's moderators have helped provide evidence that DSP's addiction to spending money never stopped when he quit buying thousands of DVDs and over priced statues. He's actually wasted $35,000+ on valueless mobile game credits. Does this addiction play into the bankruptcy at all? Will the trustee care? Will Dark somehow scam that bullshit as a "business expense" even tho he is still hiding it from the public.
- Dark claimed he gave MidFirst bank "permission" to take the smelly CT condo back and that it was positive for him.
The 'Pimp-slap the shit out of that kid' clip is short but sweet and goes a good way towards showing someone what kind of repugnant piece of shit Phil is when at a surface glace they might just think he's sort of an affable jackass.

1) Based on my numbers, DSP has received this month (between Youtube, Patreon, Twitch cheers/subs from March, and tips) approximately $9,500-$11,500 (~$11,100-$13,100 if he gets $200 per day for the rest of the month with his dumbass vest gimmick). Does this sudden uptick in income have any bearing on the trustee's decision?
2) Phil claimed $9000+ in business expenses for July 2019. He "premiered" 4 new games that cost $170 at full price and no used games that I could see listed on his schedule. He bought no new equipment (gifted one Switch controller by GrazyDream). Even doing things like including his full internet bill (~$300 based on his statements) and a double-counting of his mortgage (~$1800, which he also listed as a personal expense), I can't make it to even $3000 of expenses. Will the trustee require enumeration of his alleged expenses, will she accept them at face value, or will she simply laugh at it and tell him to eat shit?
3) Does his perjury regarding the Switch and Animal Crossing (he claimed it was a business expense, not a gift, and that it was only used for business when Kat plays it) mean anything significant? Along the same lines, Phil's talked about Kat using his PS4 Pro and/or playing games via game-sharing on PS4. He has presumably claimed those as business expenses--does Kat using them screw that up for him?
4) Does his post-marriage reveal from April 2019 when he talked about his plan to stop paying on the CT condo because he couldn't afford his bills anymore mean anything in terms of establishing insolvency? He's outright saying "I can't afford all this" and his "solution" is to have his CT condo foreclosed on.
5) Phil has received a number of giftcards and other equipment via his Amazon wishlist. Is he allowed to count any games/equipment he purchased using those as "business expenses" or are they excluded because the funds were provided as gifts? If Nick wants an amount, it's in the hundreds of dollars range, at minimum.
6) With Phil having admitted to putting both state and federal taxes on credit, will the trustee require him to list how much of each credit card debt is taxes?
7) Can Nick talk about the abuse determination described here? I can't see any way Phil cannot reasonably $6000 of his unsecured debt over 36 months, but I accept that I'm probably missing something here.
8 ) Phil's credit card payments are not included in his personal expenses despite being listed as "primarily consumer debt". Should they have been listed in his bankruptcy anywhere? Assuming they're not included in his business expenses, and with the assumption that his minimum payments were probably in the few thousand dollar range per month, is the trustee going to be trying to figure out how he was apparently losing thousands a month from April (when he stopped paying his CT mortgage) to October (when stopped paying his Citibank credit lines at minimum and probably all of them) without making any changes and apparently choosing instead to rack up even more debt?
9) Does the recently submitted amendment to the A/B/C schedule signify anything of significance, or is it just Rochelle doing her ethical minimums?
10) Based on everything that's happened (from the initial filing to the 341 meeting), what is the likeliest outcome for Phil, and why do you think that's the case?

See, that's what I was thinking, and I just assumed I was missing some obvious issue that changed what appeared to be a simple answer. Based on that, I fail to see how he doesn't meet the definition of abuse. He could drop one internet line and a couple of his monthly subscriptions and meet that target. Combine that math with his insanely inadequate application paperwork, obfuscation of assets, lack of delineation between business and personal accounts and shifty behaviour, and it’s dismissal with predjudice city, as I have been saying all along.

If it's owed on a card that's constantly maxed out with only minimums being paid how do they calculate which portion of the debt those minimum payments were applied to? In other words, if $5k of a maxed $10k limit was paid toward taxes a year ago and minimum $100 payments have been made since thenh how do they decide if he still owes $3800 or $5000 that can't be discharged? How does the interest work?
If they do determine that some outstanding CC debt was used for tax payments and not eligible for discharge how would those credit card debts be excluded? For example, if it's somehow determined that one account with a $10k balance had $5k of that go to taxes how would that account be discharged if the BK was allowed? Would he still owe $5k on that one account under the original terms of the CC contract?

What if they were paid with a cash advance from a credit card? That's how I assumed it was done having never seen a place on the 1040 for a credit card #!
It seems insane to me to put a tax bill on a 25-30% interest credit card when the IRS will give you a payment plan.

It seems insane to me to put a tax bill on a 25-30% interest credit card when the IRS will give you a payment plan.
If someone was insane enough to take out a cash advance to pay taxes, they would have paid cash for the tax bill and have a cripplingly high-rate loan to pay back to the credit card company, but no direct paper trail.
That being said, I can’t imagine it not coming out during the process that the advance was taken to pay taxes, and a large cash advance would raise the question of what it was for, and all answers to that sort of question are considered sworn statements to the court.
