That's a recent development though. The torts happened years ago.

Not really because he would have made his money by now. If anything it eliminates any future chance to mitigate the losses Waid caused.
 
If he hasn't already, I'm sure among Meyer's evidence is Waid's statements from Comicpalozza 2018 (preferably audio/video of Waid making the statements).
Those are Texas witnesses correct? They could easily be called. Where does the reporter who interviewed Waid reside? I wonder if they recorded that interview they did with Waid and there are things that were said that werent in the article

Couldnt he use the argument that he would have made more money on his Indiegogo projects afterward?

I'm not.

The two sides have been cats and dogs from the start. Meyer wants Waid to admit he is a petulant man child and say he is sorry, and Waid is a petulant man child who would sooner burn his business to the ground then admit he fucked up. This is one of those odd lawsuits where money isnt really the issue. Which makes it damnably hard to settle.
 
Eh, I think Meyer would settle if Waid made a real offer. But, I'm sure Waid is being an exceptional individual about it and continues to throw good money after bad on going to trial.

Yeah but Meyer's idea of a real offer probably involves Waid visibly and publicly apologizing, or lots and lots of money.
 
You know its wierd. Friends of Mark Waid were telling EVS that he wanted to settle. At least thats what @FROG said on one of Nicks streams. Maybe Waid didnt offer a recantation and it was just money.

He said that? I could have sworn EVS said he was approached by one of the pros who to tried to convince him to get Meyer to settle. Unless he said both and I missed it.

I mean Waid was probably considering it at some point if he's not completely braindead. But the offer being made at all meant someone in Waid's circle if not Waid himself thought this case going to court was a bad move for them. Someone was definitely scared of Meyer

This is about paying third party mediators to do ADR, though. Just because they don't want to do that doesn't mean they aren't pursuing settlement negotiations directly.

Yeah, but I doubt Waid is offering what Meyer wants, which is for him to put on sackcloth and ashes and do the Shame Walk through the city. I would be absolutely shocked if Waid did that willingly, it just does not seem to be in his character.

Oh, I don't mean the current filing. I was talking about when Meyer first filed the case in 2018 and one of Waid's pals approached EVS to convince Meyer to back down.
 
Sure, one of Mark's friends in the industry asked me to talk Zack into considering settling the case in a way in which there would be "no winners or losers." Money would be donated to charity. I can't be sure that Waid asked for this, I think it's probable that this friend was just acting on his own initiative.

I told this friend it wasn't possible, because Zack had received donations to support following the case through to trial, not to settlement. This was back in 2018.
