I agree with the rest of your post except for this bit. I think what's happening is something like he's texting her saying 'you crazy bitch, you're ruining my life' and then she says something like 'what am I supposed to do, make a post saying I've made this all up' and then he agrees and then we get those kinds of posts and videos.

There's usually an exception in those laws, either in the statute itself or court-created, for self-protection or collecting evidence. It could be that even if you could legitimately record something to use to exonerate yourself, though, that it would be illegal to use it for any other purpose.

All I mean is that by the very definition of her disorder she's emotionally unstable so her reactions aren't what most people would consider to be normal. It's an absolute shit of a mental illness to deal with, both for her and for those around her. It might not even be possible for her to integrate this into her personality.
