Congratulations, you have an Internet Degree in Law for Canuckistan. Do you have anything else to add to the thread except repeating your naysaying? This thread is brutal. I swear people believe they can have a predictive understanding of a nation's legal system because they've seen reruns of Law and Order, and they watch Scared Straight on A&E or something.
So once again:
-He will almost certainly get nothing more than community service, a fine, and probation. Possibly a peace bond. There is a bazillion case references to support this. So fuck off with the conjecture about jail. You can literally google this shit.
-He will not be put in a psych ward. That's is rare in Canada unless he pleads not criminally responsible due to a psychiatric condition. He will not do this because he is not going to face jail time. As for being committed outside of this criminal issue? Not going to happen. Even if he was full on suicidal and threatening people, he wouldn't be put in a psychiatric institute for a protracted period of time. Canada is NOT America.
-For the second time, he will not be facing a trial by jury. Those trials are very rare in Canada and they do not happen for a summary assault charge. Canada is NOT America, so fuck off with the Jury idea. Purge that sperg from your brain. Don't even type it. He will not be going before a jury.
Since we are here: Forget the concept of a big police takedown arrest with lots of oomph. From my read, he was already arrested. Here's how it goes down in Canada. He would be told he is under arrest. He would politely be asked to come with the police. He would politely be explained his rights. He would be fingerprinted and given a notice to appear. He would he be released on his own recognizance and the asked if he needed a taxi home, or would like a bus ticket. That's it. So fucking dull an event that even the cops get bored.
That's it folks. No drama. No big moment for spergy shadenfreud for you.
Now we wait for his first appearance. He can plead guilty, not guilty, or reserve his plea. Basically thats where he asks for more time to find council and consider his options.
There will then be a trial by judge if he pleads not guilty, or if he pleads guilty there will be a sentencing hearing.
That's it. That's fucking all.
Now someone asked if he can be pardoned. No, not really. Canada is not the USA. He could file for a suspension of his criminal records after he's served all conditions of all his sentences (weapons charge and any other charges) but it isn't a pardon. It just means he is removed from the criminal database (though the full record is completely restored if he fucks up again). It takes years to do that..... and yeah, technically he could be pardoned by Royal Perogative... that's where the Queen (who ultimatley is the Crown) declares him pardoned, but that doesn't happen. Not like your US president pardoning people. Again, Canada isn't the USA.
Now quit using this arrest and this thread for your bizarre assed LARPing of your TV crime drama fantasies lol.
Go on, go use Google for 10 minutes to learn just how fucking mundane Canadian law is for criminal summary assault charges..
Peace
