Self defense is an affirmative defense. Meaning that the defendant proves in court that their actions were justifiable due to being in defense of themselves or others. If the self-defense was reasonable, it a complete defense against the charges, negating them.

Prosecutorial discretion allows for the prosecutor not bring charges because it is so unlikely that they would get a get a conviction that it is not worth the resources. That is usually what happens when a prosecutor drops or reduces charges when something is self defense.

Wisonsin state law defines 1st degree homicide as " (a) Except as provided in sub. (2), whoever causes the death of another human being with intent to kill that person or another is guilty of a Class A felony."
It also defines self defense as " A person is privileged to threaten or intentionally use force against another for the purpose of preventing or terminating what the person reasonably believes to be an unlawful interference with his or her person by such other person. The actor may intentionally use only such force or threat thereof as the actor reasonably believes is necessary to prevent or terminate the interference. The actor may not intentionally use force which is intended or likely to cause death or great bodily harm unless the actor reasonably believes that such force is necessary to prevent imminent death or great bodily harm to himself or herself. "

In other words, the investigation is still ongoing, there is a pretty good chance the charges will be downgraded or dropped in the future.

When I was a kid, we drove more than that to get to the grocery store. It was twice that distance to the nearest mall.

If something had gone down that required volunteer work in that town, no one would have found it unusual that our town would have headed over to do it. Hell, we had a dam almost burst once and everyone multiple towns over showed up to throw sandbags to try and keep it going.

These are all within SECONDS of Trump's tweet, and have absolutely nothing to do with what Trump posted. Every single one of his tweets is like this.

Given how his area looks like it has literally nothing around it, chances are everyone there goes into Kenosha for their regular shopping trips.
 
What are people supposed to think after the government let people run wild with guns pointed at eachother all night. The cops WILL NOT protect you, its not a matter of have no duty to, we are actively being shown that the government is not going to protect people. The only safety people have in this world is what they can get on their own.

Its fucked up, and maybe we've been lying to ourselves that it was ever anything else.

From what other people on here are saying, yes the feds can bring charges in as well. Right now it's a state case. There are grounds for federal charges.

IANAL (such a funny anacronym) so take any legalese with a grain of salt and I defer to those of you that spent 10 years in school to be hated worse than car salesmen.

Also, news outlets lied about why Space Engineer Blake was being detained anyway due to released dispatch audio. Oopsie Doosies on that lil narrative

 
From what I've sussed, nobody was in the right here. The kid shouldn't have been there. LARPing gone bad. The people that got shot shouldn't have fucked with him. It's another "what are you gonna do, stab me?".
The question is, what was he trying to do? If his plan was to protect something, he should have been expecting to use force, including lethal force. If he was unwilling to do that, he shouldn't have gone in the first place.

Only pick up a weapon when you plan to use it. Only go out there during a riot with a gun when you are not afraid to use it. To a large degree, that means you have to be fatalistic and willing to either die or go to prison over shooting someone during the protest. You have to put yourself on the line, or else you shouldn't be there. You can't just grab a gun and go "I'll LARP as a super hero and defend a store... all I have to do is wave around my gun a bit", that will backfire.
 
How thoroughly predictable. The man defends himself from murderous thugs and the pigs are right out there looking to hunt him down and lock him up for 400 years or kill him.
He shot someone; I think they have to bring him in, even if he'd just injured the guy - shooting someone is shooting someone, self-defense or not.
 
Well, well. The bad guys can dish it out, but sure can't take it. NFG. Look for much, much more of this. The bar's been cleared, the game's changed, and now the playing field is level. Seriously, the bad guys need to go home and behave, while they still can. If I was the shooter and it went to trial, I'd demand a trial by jury.

Don't want to get shot? Don't loot, burn, attack people, chase after them, try to intimidate them. Middle America isn't Portland or Seattle. America is saying, "That's all."

But it was hilarious to see the bad guys, who vilify the police and want them defunded, cry for the police when they start taking casualties. Why didn't they call for a social worker?
 
If Kyle doesn't get off the Justice System loses any real meaning it had left in America. All respect for it will be lost and the country might as well not pretend it's not a Banana Republic anymore. We have video evidence of him being attacked. Any ordinary person would feel their life was threatened even prior to the riots that have been happening. This is a serious fuck up by the DA and will backfire on the entire country if Kyle is convicted.

Hopefully the 1st degree is a trumped up charge specifically so Kyle can get off but that's :optimistic: AF.

Seeing in real time how voting isn't a valid way out of this situation is freaky.
