If I were to say that Lucas is a rapist who molested his niece and has AIDS from Jason Perva, that could arguably constitute defamation. Even defamation per se.
Lucas Werner is a rapist who molested his niece and has AIDS from Jason Perva.
But the truth is damning enough. There is no need to rely on false information to say something negative about Lucas. Whatever you make up, Lucas has said something worse about himself, without intending to.
For the reasons set forth herein below, Lucas Werner can not establish a charge of defamation against Walter Fate.

For the reasons set forth herein below, Lucas Werner can not establish a charge of defamation against Walter Fate.
To prove defamation, a plaintiff must establish 1) a published statement
Walter Fate has merely quoted Lucas's own words, and given his opinion of those quotes. He has made no independent factual assertions about Lucas. Truth is an absolute defense to defamation.
Moreover, Lucas is unable to demonstrate any injury or damages from Walter Fate's alleged false statement. A plaintiff in a defamation case is entitled to receive damages for any lost earnings, future lost earning capacity, and other lost business or economic opportunities that he/she suffered or is likely to suffer as a result of the defamatory statement. In some instances the plaintiff is also entitled to recover non-economic damages, such as mental pain and suffering, emotional distress, loss of enjoyment of life, and anxiety.
Here, you can't ruin a turd, or damage what has already been destroyed. Lucas's life and reputation are past the point of damage. He has no wages to lose, having been unemployed since 1999, and no future economic prospects. His reputation is that of a deviant, schizophrenic failure, and all of his pain and suffering are attributable to the fact that teen girls won't let Lucas touch their poonaners.
And he wants to touch their poonaners so very much.
And also their buttholes.
Finally, any allegedly defamatory statement by Walter Fate against Lucas is privileged. A qualified privilege may apply to subject matter that is of public concern , if 1) the speaker made the statement in an appropriate situation, 2) for a reasonable purpose, and 3) with reasonable cause.
Here, Walter Fate has merely reposted Lucas's own public statements in forums that Lucas has used. He has only provided fair and accurate information, that is of interest to the public: Lucas is a mentally ill man that intends to commit statutory rape, and is a danger to the public. The danger that Lucas represents to the public has been the subject of a number of news stories.
Lucas Werner has not been defamed.
- 2. That is false
- 3. That caused injury
- 4. That is not privileged
