No, Trump can nominate someone immediately, But I'm betting McConnell wont move on it. There are enough wishy-washy RINOs to put it in danger of defeat. A quick confirmation would be unlikely to happen anyway. At least not as quickly as would make a difference to the vote. Trump can nominate the same person after 11/3, even if he loses.

Cocaine Mitch has this election to worry about as well. The Senate is totally up for grabs this year; it's very possible for the GOP to lose the majority.

If Mitch moves forward, that will only energize the Republican voting base. He has a LOT to gain here.
