If the Republicans go for it (Which, for the record, I don’t think that McConnell will. The man is all about precedent.) they’d be playing by the rules that Democrats wanted to play by in 2016, ignoring their own precedent. Literally called the Biden rule. Democrats agitated for it during Obama’s final year because they were too stupid realize that doing so while they didn’t hold the senate was a fool’s errand. It would be just as easy to say “we’ll try it your way. Hearing’s in a week.”, they would again have no one to blame but themselves because these are the rules that they wanted to play by.

And if you think that March or September is a meaningful difference? Well, the difference between March of 2016 and November of 2015 was wasn’t a meaningful difference to the dems four years ago when it was a precedent that Joe Biden set.

Tactically? This will benefit whoever exploits this better and Trump already ran this page out of the playbook the first time that he was up for election with Scalia.

The democrats under obama removed the ability to filibuster or obstruct a court appointment. Now all that is needed is a simple majority vote from the senate to confirm a candidate.
