I've won several cases at the state level.
Big federal courts are a different ball game. The thing about law is, it's all or nothing. Either you get it 100% or you're out. You can't do it 92%, or 95%, or 99%. I've gained more experience over the last few years, to work out the kinks in my pleadings.
The other issue is that some of the stuff I filed for had no precedent in the Fourth District. I was the first one to bring up the issues and file. So, when you are breaking new ground and asking a court to rule on an issue for the first time, there is a high chance for dismissal.
The third issue is that the Supreme Court of the United States cannot accept 100% of cases. Neither can the Supreme Court of Virginia. Unfortunately, social injustice cannot always be cured. They even say that on the Supreme Court website, that they can't fix of all society's wrongs because they can only handle so many cases.

It's not a well studied issue. So I can't give you a list of studies. I did post studies here already showing that semen can go through the vaginal wall and into a woman's blood stream.
There's just some things that you can know from observing people and their experiences.
People have known things in history, only for science to later catch up and put it in a study.
For example, it is common knowledge to "give us this day our daily bread". That humans need grains/bread to survive. And then later science proves that lack of whole grains is directly related to heart disease.
There are different ways of knowing. Science isn't the only way to figure things out. Women and men with white hair know a lot too, even before science was a thing!
I don't have access to grants and research resources to conduct experiments to test my hypothesis. The other factor is -- how many women would admit to having sex while pregnant with someone who is not the biological father of the child? There are social, religious and cultural barriers to women being open to that, even anonymously.
However, here is another
way of knowing. The Torah put/places these sexual restrictions on people:
- Only a widow who is childless, can marry her nearest kinsman relative (Deut. 25:5-10).
- It also says sex makes a marriage (Gen. 24:67)/(Ezek. 16:

- It also says that a woman who commits adultery should die (Lev. 20:10)
These are all ways in which semen can affect maternal/fetus DNA. The Torah saves the lengthy process of science and proves things by moral philosophy.
Interestingly, I believed only from reading The Torah that (consensual) sex = marriage. Only to later read that science had caught up to prove that semen passes through the vaginal wall into a woman's blood stream. Makes a married couple like one blood.
