I don't know how a film that fails the DOST test multiple times counts as something that should be protected by the first amendment. Isn't DOST's entire point to decide where exactly the line between expression and porn is?
Well...the Dost test actually is not 100% authoritative. If content fails Dost but passes Miller, it can still be protected by 1A, and in practice all these tests are way more subjective than anyone wants to admit. Remember, 1A is a strict scrutiny situation, that weighs heavily in Cuties favor whether we like it or not.

The Dost test is a great yardstick in the context of a good faith assessment by those not part of the justice system to determine whether content is more or less likely to be protected, but only the court can decide and that's case by case and informed heavily by very strong case law.
 
I would agree but I honestly don't know how this will play out now. As for any of the actors coming out about anything, I don't think they would. This was a French production, keep in mind. Over in France shit like this is probably normal or at least not nearly looked down upon as it is in the US. The child actors probably won't say anything because they can be told just about anything in regards to why people are outraged about the film, and the other cast members probably all side with the production, either because they actually don't see the issue or because it could cost them their careers, but that's utter speculation.

Only time will tell if this will gain any traction. People need to keep making noise, though, especially now that there's a case. I think that's all anyone can do at this point.
It's relatively normal in North America as well, there's enough 12-14 year olds who appear in sexual advertisements and media. It's also not uncommon for the young children to be "dating" someone in their 20s-30s. It's just that the young children and teenagers who are sexualized are also aged up, therefore people can't tell as easily.

And I too understand art films and pushing boundaries within art, but I'm starting to think some topics really can't be depicted or criticized through film in this way.

Happiness is a film that was able to successfully depict a similar dark topic that pushed mainstream boundaries using comedy. The film really didn't show anything; it was left to the viewer's uncomfortable imagination. This is just softcore child porn.

Another difference between books like Lolita or movies like Happiness or A Serbian Film is that despite their disturbing content, no actual children were harmed in making those works.

A Serbian Film's gruesome rape scenes were often done using special effects or young looking adult actors while the characters in Kids and Happiness were all played by younger adults

Cuties used actual child actors. That's part of why it's so utterly horrifying. If that French lady wanted to actuallt make a movie about the horrors of child exploitation, wouldn't it make more sense to get adult actors who look young instead?

If this was ten years ago, Netflix would have just cancelled the show. The fact that they are fighting this in court is their way of testing their power to see how much they can get away with. The Obama connection to Netflix is interesting; is Netflix angling to become a propaganda vessel for the DNC and their masters? If Netflix wins this case, will it give them the green light to start publishing fraudulent documentaries on people and companies that have problematic opinions?

If a normal person was distributing twerking/upskirt videos of 11 year olds to all 50 states, they would most likely be serving time in Leavenworth, so fuck Netflix for being above the law on this.
