Yes, the cinematographer, the editor, the director, and the distributer. Netflix is the only one of those who is under American jurisdiction.

Which is a very good thing for the casting directors who auditioned and filmed 600+ sub 13 year old girls who had to twerk to get the part.
 
If this was ten years ago, Netflix would have just cancelled the show. The fact that they are fighting this in court is their way of testing their power to see how much they can get away with. The Obama connection to Netflix is interesting; is Netflix angling to become a propaganda vessel for the DNC and their masters? If Netflix wins this case, will it give them the green light to start publishing fraudulent documentaries on people and companies that have problematic opinions?

If a normal person was distributing twerking/upskirt videos of 11 year olds to all 50 states, they would most likely be serving time in Leavenworth, so fuck Netflix for being above the law on this.

I don't know how a film that fails the DOST test multiple times counts as something that should be protected by the first amendment. Isn't DOST's entire point to decide where exactly the line between expression and porn is?

They're probably going to settle out of court. Shell out a few million, and this all goes away.
This is not a civil case, that's not how this works. A State prosecutor has decided to bring up charges and had them confirmed by a Grand jury. The most netflix can hope for assuming its not gonna fight it in court is a plea bargain, which would be a reduction to another charge, or reduction of sentence in exchange for pleading guilty.
A civil case is when two people sue each other, you can make settlements and deals to end the suit.
That is not what this is.

I don't think it will matter however, Netflix will fight this and unfortunately likely win, its too easy to show enough political and artistic intent to provide an affirmative defense of the charge.
 
Told my mom about this as part of the pre-work morning news; after I explained Cuties controversy to her, she said that women are allowed to be pedos/rapists cause of "suffering through enough"...got so mad I saw red.
So, to stop the wage-gap, women need to sexually abuse little girls? Weird take, but alright.
