Well, san francisco had some action - which is actually surprising, because despite its liberal reputation there haven't been any major riots or protests there - its too gentrified and techie to truly pull the insanity you see in portland. Anyway apparently saturday SFPD killed an out-of-towner who was carjacking with a knife. So cue outrage. However this doesn't feel like homegrown outrage, and many of the streamers I recognized from other protests. They were met with many folks pushing back from apartments when "out of your home and into the street"ed - umm, folks have work Tuesday. Usual shrieking at the police who eventually stopped them from marching down the street and yelling at people in homes. What looked like a vet confronted the protesters saying "you aren't welcome here" before getting assaulted (sucker punched) as the woke stream went predictably blurry.

Whoever gets this on their docket is going to lean hard on the state and the defense to reach a plea. Offering anything lower than murder in the second degree will provoke a shitstorm of Biblical magnitude, in and out of Colorado. Even in a dead-to-rights murder case like this, appeals are guaranteed and no judge likes being overturned on rulings or verdicts.

What people need to remember is that self-defense is an affirmative defense and functions as a guilty plea to the charged offenses. The judge is not obligated to accept either the plea or allow the self-defense claim, for the reasons you suggested. In the razor thin likelihood a jury buys self-defense on these facts, it's pretty much open season in Colorado for outright political murder, in which case the judge would want it appealed so that he doesn't have to make that call.
