To be frank the tactic of getting "affidavits" from a web form or some shit and then auto-notarizing them, from people you don't even know who the fuck they are, is a seriously low-IQ strategy in the first place.

ETA hasn't done anything for years and was fully disarmed in 2017 and dismantled in 2018. That sure as shit hasn't kept the PP from namedropping them 'bout 3 times per minute and trying to use them as justification to excuse hate speech laws and opinion surveilance (thankfully with no success because we do have a constitutional right to freedom of speech no matter how hard they ree.) So I don't see why you think the dissolution of the proud boys would ever keep the dems from using them as an excuse in the same way.

I guess they couldn't find enough witnesses to get sworn testimony under oath. I forget, for it to count as being under oath, must it be subject to the Sixth Amendment Confrontation Clause?

Testimony, yes. But even affidavits, you're at least theoretically supposed to do some independent verification, not just spam the court with a bunch of crap and say "no, you do the investigation."

So what you're saying is that for even those testimonies given in PA by the postal workers, that may also be discarded if opposing counsel wasn't given the opportunity to cross-examine?
