The legal standards for fraud are much higher than a miscount in good faith and right now the trump legal strategy is to rush these cases to SCOTUS for judgement, asserting good faith miscounting is the quickest way to get there.

There's plenty of lawsuits still going on, you can appeal dismissals. At last count I saw about 16 lawsuits or so still active and climbing up the rungs of the court system on the way to SCOTUS.
