I personally think it's stronger and more persuasive to state things bluntly. When I read anything that's written flippantly like that I dismiss it intellectually. If I wanted to read ironic bullshit I wouldn't read a Justice's decision, but it was brought to me, here, and to my suprise, it had the same tone as everything else - so I gave my opinion.Then let me provide a counter idea, the purpose of this decision -is- to persuade. Or ore specifically, inform while noting purpose. He is clearly noting that the restrictions are arbitrary and often contradictory. He does so with rhetorical flair, both out of anger and to note to anyone who reads it that it IS arbitrary and he is making it clear that he will not stand for it.
