I'm more inclined to believe Trump's team was flailing about legally speaking, but other people unrelated to them were quietly watching from behind the scenes and working to get an actual workable case put forward. That's understandable. I generally don't think Trump is a 4D chess guy. Though it becomes more plausible in this case when you consider this: Was this ever NOT going to the SCOTUS? Even if Trump won in won of those lesser courts, it would have been appealed by the defense all the way up to SCOTUS all the same. Everyone knew that. We've arrived at the inevitability and what I've been saying for a month has been proven true.

The problem is that Presidents have to go from lower courts to state SCs to the USSC, while in state vs state fights it goes straight to the USSC every time.
