Lolcow Melinda Leigh Scott & Marshall Castersen - Sue-happy couple. Flat earth conspiracists. Pretending to be Jewish. Believe Kiwi Farms is protected by the Masonic Order. 0-6 on lawsuits. Marshall is dead.

I wonder if she even realizes that she's up against a actual, real lawyer, not some sperg who went to a shitty college and grabbed a degree a lobotomized chimp could have been granted?
I think you underestimate her opinion about her legal skills almost as much as she overestimates them. She's just as good as any real lawyer, she thinks; she just dropped out of law school because of reasons. She totally could've finished the degree and got the license, or so she believes. She just didn't see it as necessary.

Why would she spend a ton of time and money on law school and then get a law degree, so that she could represent someone else, when she only cares about herself anyway? She doesn't need a license to represent herself.
Because you'll see it in my reply headed to the courthouse this week

14 pages. 2891 words.
And you claim that there's no proof that KiwiFarms user "@TamarYaelBatYah" is actually Melinda Scott.
She has two older sisters and her mother seemed to have been well liked by everyone. To me, it just looks like the youngest child didn't get enough attention when normally they should. Probably was always told why can't you be like Christine or Melissa. Given her temper tantrums as an adult, it's safe to assume she had them even worse as a child.
I 100% blame nature, not nurture.

If she was a normal person, money.

I really hope that Null's lawyer hammers down as hard as possible on the fact that Mel has admited that her motion to strike was frivolous.

New Filling! Mel wrote a motion to compell. The weakness? Null was never properly served, and so her time argument is meaningless. Technically Null did receive the default notice from the court, but that hardly counts as her serving Null, and even if it did, Null only received it on the 3rd, that being 13 days ago, not the 30 days needed for the motion to compel as per Mel's own admission

Pathetic.

Why doesn't she serve this to Null's attorney?

What a dopey cunt this silly bitch is. I feel so sorry for her children, at least three of which are bound to be inbred.

How can you demand production of documents for a lawsuit that hasn't been served. The only way a person can be this fucking dumb is if one of their previous husbands had a good right hook and repeatedly inflicted a concussion that was never treated in hospital.

If she really wanted this motion to have the best chance of success she should have filled it only if the court upheld that her poor servicing was valid. Filling this in the middle of an argument about whatever or not she served him is just a waste of literally everyone's time. The judge will either dismiss it outright, or only rule on it after he ruled on Null's motion to overturn the default

Because she wants the court to make Null give her info. If she sent it to Null's lawyer, best she would get in responce would be "we might send you something in about 30 days" or just "fuck off"
Isn't it improper to communicate directly to a party when you know that they're represented by counsel? In fact I believe it's sanctionable.

What exactly is she hoping for him to produce?
Basically she wants him to dox @TheJumpingDwarf, @Rafal Gan Ganowicz, @Deadpool, and @Karl_der_Grosse.

Her request for production of documents was Document 18-1, posted here:
NEW UPDATE TO THE SUIT. "PETITION AND AFFIDAVIT FOR DEFAULT JUDGMENT", "PLAINTIFF'S FIRST REQUEST F0R PRODUCTION FROM DEFENDANT JOSHUA MOON" was filled by Plaintiff.

My Thoughts:

The petition is about what'd you expect. It's hard to fuck that up. Weird choice of mailing address though.

Second motion. Rule 34 is limited by Rule 26, which only allows "the name and, if known, the address and telephone number of each individual likely to have discoverable information". This is a problem, because she is asking for an email, which Rule 26, and 34 cannot give. Rule 34 is a poor choice, regardless, because it focuses on documents, not names or addresses. Not sure how Null is supposed to know and produce info on whatever or not "TheJumpingDwarf", "Karl_der_Grosse", "Deadpool", "Rafal Gan Ganowich" have alts, or how he is supposed to have their legal names/telephone numbers. Rule 26/34 does not allow demand of IP adresses, so that is a fuck up too.

To summarise, most of it is asking for things Null does not have access to, or things that the Rules do not allow her to ask.

It's hilarious that even if she could get Null to hand over their info, all he could give would be an IP (Which aren't reliable due to VPNs/Proxies) and an email (Which can be made by anyone). Nothing he could give would be able to adequately identify them in court.

Sorry, I type fast.

She hasn't, has she? This was sent to the court, and via it to his lawyer.

Things that Null either does not have or cannot be compelled to produce

Null's lawyer replied to her motion to compel by pointing out some of the things I did, and asking for more time

Stop trying to imitate me poser. Every knows that I'm the nazi round here.
Anyway, Melinda is still desperate to find out who certain posters are and mistakenly believes that null, and now his lawyer are sitting on some kind of list with everybody's true and honest information on it, and that she can force them through the court to give it to her.
Problem is, this information doesn't exist, as no one uses actual emails connected to real identities, people change or hide IP's which don't identify anyway. It's not like she doesn't have access to the same database leak that we all have.
She's obsessed with certain users, and it seems to me that this whole court proceeding has nothing to do with her getting a judgement against null or the farms any more, she just wants to use it to make motions to try and exercise her will over people.

She's required to serve it on all parties, and her certificate of service says that she sent it to Josh instead of his lawyer.

Well then she is retarded and you are completely right

Funny thing is that all she wants either court is not allowed to request or Null doesn't have. Null's lawyer might just send her an email saying "here's the data you asked for" and the email would be blank

Edit: Null's Lawyer is a God at fast responding. Normally it takes at least a day, but he responded within an hour(to the best of my knowledge) after it was posted on Pacer. It even has great arguments. However much Null is paying him, it's not enough

Curse of ten yahoos upon you, fellow k-farmers. This is truly a legal battle of the ages. The following narc injury will be great to witness, especially when reflecting upon her almost manic blissposting. Granted, she will try to twist and force meanings to fit in her worldview, conveniently skip over everything that doesn't support her viewpoints and continue the flinging of her favourite accusations in the meanwhile. So just wait for a while fellow kiwis, this might actually be interesting.
