I hate to say it, but talking like that, around here, he'd be considered normal..... there's so much bad grammar around here it makes my frontal lobes ache at times, a unique blend of redneck, PA Dutch and Pittsburgh "Yinzer" that comes out the lingual version of fingernails on a chalkboard...... and it's even HARDER when the person speaking it is just plain DUMB on top of it all. For example, spouting off about how the moon landings were fake, but pro wrestling is real......
Willful copyright infringement can be a crime under certain circumstances, but not inherently. Nevertheless, putting fraudulent copyright notices on a work is copyfraud, I believe. Civil, criminal, either way, what Len did was illegal there. And, it looks like what Len did is a crime too.[1]
This is where the old "ham sandwich" comes in. If there was an AUSA that felt similarly about Len as I do it wouldn't be too hard to bootstrap this one: That's a professional quality photograph (presumably taken by a professional photographer), so I would be shocked if the prints aren't eventually available at a fee ("commercial distribution") as part of an event-centered "pay me $59.99 and you can get this gorgeous print of your hippie ass being knocked in the river" sort of deal.
NB. In addition, a fraudulent copyright notice (which Shaner has certainly done here) is sufficient to establish liability under the statute.
I did a little digging, and found the following photos, which show that the pics you posted were indeed taken earlier today at Schuylkill Canal Day.
The first is of the canal jousting event that you claim to have photographed:
The second, however, is far more instructive.
This wider shot shows us the vantage point from which "you" took the picture you posted. Here we see a man in a red shirt, tan shorts, and a navy blue / purple ball cap, with a camera around his neck in the exact position (top of the stairs, left arm resting on the railing) where the photos you claim to have taken were taken, 15 minutes before you claim to have taken them.
Now, I will grant that the photo is a bit grainy. And the man in question is a chubby white guy in his 50s. But that gut is nowhere near your now legendary Drooping Belly of Fail.
I will find the actual photographer. Whose work you stole and posted as your own (with a copyright symbol!!!) on these pages.
Willful copyright infringement isn't just wrong, it is a federal crime. And, happily enough, a full dozen (give or take) of my law school classmates are now federal prosecutors (@AnOminous knows which law school I went to and can confirm this isn't an exaggeration).
Don't worry, I'll be truly surprised if anything comes of it. But when little shits like you keep playing with fire, they eventually wind up burning on someone's doorstep. Just sayin' . . .
PS. Field agents who are friends with Lenny on Facebook: If you get a moment, save me some time and check to see if any of the myriad local photographers he follows/stalks (a) look like Navy/Purple Ball Cap Man, and (b) posted similar photos on his page.
In an effort to help with analysis:
The vantage point of Purple Hat Man doesn't match up with "Shaner"'s photo. Blue Hair Man is on the same end of the green pole in the first of your pics as with Shaner's picture, but the positioning of BHM in Shaner's is opposite of what PHM would have seen. BHM would be on the left side of the photo instead of the right. Shaner's shot isn't mirrored, either; a woman in the top left corner has a blue and red bag with the letter B printed on, and that's still readable.
I'd say you're gonna be looking on the opposite bank from PHM, a bit closer to the edge of the water. If anybody can get pics of that side, it would help.
EDIT: 100% sure it's still not Shaner's photography.
