The best way to win a clear constitutional challenge is to prevent a bill from becoming law in the first place, and the best way to do that is strangle it in the crib. If it makes it out of the crib, keep assaulting it until it dies. Trusting the other house of Congress to do the right thing is far too risky. Hoping five people in black robes will do the right thing has rarely worked out. I'm still waiting for them to restore the 2nd Amendment rights we lost in 1934.
