In the case of a non-public figure, the standard is negligence. Even if you genuinely believed Vic Lasagna is a horrible pedorapist, and said as such all over twitter, you'd get slammed with defamation.

For a (limited) public figure, the standard is actual malice, that is, knowledge of falsity (you know it was a lie, but told the lie anyway) or reckless disregard for the truth (you had serious doubts about how true it was, but you went ahead and spread the lie anyway).

So, what did the courts say?

According to TCPA standards, Vic's version of events is held to be true, while the defendant's (let's use Monica) is held to be false. Monica claimed Vic attacked her in the hotel room. Vic says lol, no.

So no, Monica screeching "but I believed it was true!" wouldn't overcome he-said she-said, where the he, in this case Vic, is presumed to be telling the truth at the TCPA stage.

My head hurts.


The worst part is, I went through this phase myself for a long while. I missed a lot of shit I still have to watch many shows like Bunny Girl Senpai, MILF Isekai, & many more because I was waiting on the dub for them.

God I fucked up.

This is an honest question because I really don't know. Maybe @AnOminous has some thoughts. A lot of these wicked little spits are empty wells when it comes to pursuing legal action.

Is there something feasible that can be done to shut these speds up? Or does Vic just have to win big enough that he can financially weather these worthless trash piles constantly nipping at his heels? I mean they're like a swarm of gnats and their continuing will always be a thorn in his flesh.

His only option is to warn cons that bring him on that there will be messaging and harassing the con to cancel him and more. Winning the lawsuit or it even coming back on appeals would be a big win.

Restraining orders would help.
 
I don’t think restraining orders do anything for these psychos contacting his convention appearances and other things though.
There are these miraculous pills that Vic could always force-feed his detractors to make them shut up.

The real question is if violating a restraining order can net you criminal penalties. They might realize they're too poor to pursue civilly, so they can harass Vic and the cons to their hearts content. They might be a lot less inclined to do so if they have to spend a few months in jail for doing so.

I honestly don't know if a restraining order not arising from something like domestic violence can get you jailed, though.

There's not a thing he can really do to these broke-brained, broke-dicked, just plain old broke fuckwads. In theory he could sue and get an injunction against them, and somehow enforce it where they live by domesticating the judgment, then hold them in contempt if they violate it, and then when they can't pay but continue doing it, actually move to have them incarcerated for contempt instead of just fined, but this would be expensive, wouldn't pay for itself, and we're at the point where he really has to win appeals at least partly even to move forward at all.

So, some pathetic lunatic like this Cooley fuckstain is almost certainly essentially judgment proof. I can't imagine a weird, creepy mental case like this having any kind of real income.

The good thing about these mental cases is if the case ever does get to a damages phase, the fact these nutjobs will continue defaming Vic no matter what means his reputation is permanently damaged and he can take those damages out on the defendants who caused them with their smear campaign.

But we're a bunch of contingencies away from anything like justice.

It's all hypotheticals and optimism, but it tickles me that every single tweet from, say, Disabled Abel, or BT, or Manjawlo, or Emile Plank could tack on another $500 to any judgement against the defendants.

The most optimistic would be that if Vic wins, things will be more in his favor slightly. But cancel culture, metoo, believeallwahmens have shown to never care about proof and courts showing innocence, and (for the most part, neither do the people/companies they bug to cancel people) tend to get their way.
