This is going back a few pages, but to answer this, William Peter Blatty sued the NYT arguing that his book should've been included on the list due to strong sales. The NYT's rebuttal was to argue that the Bestseller List wasn't mathematical, but rather editorial content.

The Times Bestseller list is bullshit at best. Even accounting for 'editorial oversight' and having the list be curated, there are numerous instances of titles being manipulated onto the list and there's even a company, ResultSource that specializes in getting books onto bestseller lists.
