What also came up in the Defense opening statement is that Floyd thought his pills were Percocet, but in reality those pills were meth and fentanyl. This is great, because now that is another element that puts the blame on someone that isn't Floyd or Chauvin. See, it wasn't that Chauvin is an evil honkey, or Floyd is a suicidal thug - the problem is that someone fed the poor dindu a poison!

i read on wikipedia (lol, its an edit warzone) that the family had a private autopsy held a week after the official autopsy and found he died due to asphyxiation. In the video the knee was also on the neck not the upper shoulders
iirc they didnt have a second autopsy, they hired a private pathologist to write some kind of autopsy review based on the results of the original one

An unconscious reaction/muscle memory/death cry is surely completely different to actually saying words, you have to actually move and use lungs, throat, tongue, lips, etc. to produce words.

I'd love to see those sources, to actually understand, what exactly, is being determined as 'talking'.

If you’re talking sentencing, that’s not usually up to a jury. They say guilty or not guilty on each charge, and the judge decides the penalty for the charges the defendant is found guilty on.

My money says there’ll be a guilty verdict on whatever the state’s version of negligent homicide is (because when he went quiet and limp, the cops didn’t put him in the recovery position or start CPR) and a sentence of like 5 years, which will cause rage on both sides of the aisle.
I don't think they would go the milquetoast route. Think about it. What would they rather deal with? The left, who are well known for their widespread and destructive chimpouts? Or the right, who are well known for being all bark and no bite. If they do anything less of what the loudest group wants them to do it would mean more riots. And who knows, the right might just be ready to explode given how last year went. If the left ends up having another summer long riot, that may just set off the right enough to start causing trouble themselves.

In short, they will no doubt choose the safest option. It's just kangaroo court.

I'd heard this also but have been unable to corroborate. Certainly this clarification is nowhere I could find it, despite having read about it last year.

I could relate detailed case studies (accident investigations) by OSHA, but I'm not going to power level over a stupid argument so I'll say this:

If you have air in your lungs, you can speak with that air. There are more muscles available in the body to hold air in your lungs than there are to inhale. Only your diaphragm can inflate your lungs. Unless you're a true retard with zero situational awareness and complete lack of bodily autonomy, you will be able to identify yourself in a situation where you will not be able to breathe.

On the OSHA note: individuals that are crushed to death by falling into machinery or by having objects fall on them will appear to consciously cry out when in fact they are already dead or are a literal fraction of a second from being dead. The rapid expulsion of air forces stimulation of the vocal cords.
Dumb pedantry. Sorry I didn't address the edge case where if you have a single lungful of air your can basically make a death growl before you die, I guess.

I'm obviously talking about the case where someone says they can't breathe for several minutes at a time, especially when that person was saying that before they were even on the ground. They probably should've gotten suspicious when Floyd went quiet, but that's neither here nor there considering the prosecution is talking about a 'blood choke' and not an 'air choke'.

I've been "sucker choked out" by some dipshit at a party before, and I definitely couldn't breathe or speak before I went down. Same reason they teach you "if the person can cough, they can breathe" as part of choking triage in First Aid.

Not that versed in legal speak, but isn't this requiring the defence to simply show that the defendant wasn't preemptive and actively trying to murder ol' George? Could probably pin manslaughter or wrongful death here, but third degree is almost as if the state wants it flung out.

I believe they have to prove it was done with a depraved mind for 3rd degree murder. (Like saying get in the car while on his neck for example) Manslaughter is like unintentional murder or accidental negligence. Something along those lines.
