I’m going to play black guy’s advocate here and suggest that the law will find the smallest reason to prosecute someone (or even make one up) if it’s someone they WANT to prosecute. Try applying your logic to CCP dissidents and see if your opinion changes.

No, the issue is causation. You have to prove that the actions of the person resulted in death. In this case Chauvin didn't shove fentanyl down Floyd's throat so the point is moot.

I think its pretty likely that no matter what the police did, he would have died anyways.

That's exactly why these charges are inappropriate, dude.

They will then argue that, while it may have been procedure (eliminating 2nd degree murder), continuing said procedure past x point when there are other options Chauvin could have employed (which they will likely successfully argue), evidences that situation with unreasonable risk.

Just like in the previous thread, I'll ask you to provide the training materials, manuals, policy or guidelines on this. You have no idea how personal restraint works, how or why police procedure is structured in general, and zero knowledge about Chauvins training in specific.

In this case, its actually proving that he put Floyd in an unreasonable situation which could have contributed to death.

I expect the defense to bring in actual, qualified experts to explain the police procedures Chauvin was trained and expected to use. People that have actual degrees and expertise in their fields. Those cost money though so I don't know what the defense's funding is at this point.

Police union is funding defense and spending quite a pretty penny - I don't think the cost of an expert witness is a big deal here.
