But even with actus reus, you still need mens rea, a criminal state of mind. This has to be more than simple negligence, and it varies for the different degrees of homicide charged here. The only place where mens rea is fairly easily provable is in some form of assault. Chauvin clearly intended to commit the physical actions he did. For anything else, he has to have either actually intended the result, that is, the death of Floyd, or show reckless disregard or depraved indifference as to the result.

Except Minnesota uses a version of the felony murder rule where felony assault doesn't merge, so assault can serve as a predicate offense. Hence murder 2 being a charge. See State v. Branson, 487 N.W.2d 880, 884 (Minn. 1992); Minn. Stat. § 609.19(2)(1) (2015).

I really want to see a 12 Angry Men version of the Derek Chauvin trial. Based Henry Fonda will bring in a fentanyl pill and drop it on the table in place of the knife from the movie. The spectacled juror will be a liberal. The racist juror who gets ignored till he gives up is a black supremacist. In the past few days I went from thinking that Chauvin is guilty of criminal negligence to thinking that honestly Floyd just straight up ODed despite the best efforts of every party involved. And frankly it's entirely because of evidence provided by the prosecution.

Possibly, but considering the amount he ingested and how fast Fent hits + mechanism of its effect on the lungs would most likely have needed multiple shots.

I've honestly not heard this about narcan until reading this thread. I'd always assumed that it was just 'thing that treats opiate overdose symptoms' but nope it's actually potentially hazardous if you have underlying health problems. Good to know I guess.

For those of you who have not seen this before, here's a TL;DR - Working hard, having a family, valuing religion, science, individualism, etc. is bad because it's part of white culture. Probably a controversial opinion but I'll stand by it even if everyone here disagrees: shrooms should be legalized as a psychiatric medicine. I'm not going to power-level other than to say that if you use them responsibly (as in once every few months, and in very small doses), they do wonders for mood disorders. And emphasis on 'use responsibly' because if the dose is too high it has the opposite effect.

The prohibitionist inclination will be to use a slippery slope argument, and that's definitely a valid opinion on the matter (and on many others, such as with the LGBT, and I say this as a supergay), but as a corollary: vyvanse and ritalin have been around for medical use for decades, are VERY (almost absurdly) abusable, yet no one is pushing to make them legal recreationally. It is possible to make these substances legal for medical use without opening the flood-gates to recreational use. Though aside from morons going out in public on them (which happens anyway), I wouldn't really have a problem with a sort of limited legality (don't possess too much or have too much in your system, akin to how my country handles weed).

As for the quoted user, he's clearly got a few screws loose in ways that aren't entirely drug related (or at least aren't shroom related).
