And culpable negligence, as in that statute, is a much higher standard than the level of negligence that applies in a civil case. It is an actual mens rea, not just mere carelessness. It requires an actual criminal state of mind.

The highlighted part is what almost no one gets right about manslaughter. Some people are literally incapable of making the distinction, even legal professionals.

If Chauvin beats that charge you can expect to see an absolute shitshow. A few years ago in Canada when the verdict for the Gerald Stanley case was made there were law students refusing to attend lectures covering the case because it hurt their feelings.

Not sure why Nelson is focusing on the strangulation area, this seems like a bad line of questioning, maybe something will come of it.

I don't think the question of if he was strangled by neck compression actually matters that much.

Because the prosecution is going to bring out a fuckton of medical experts still that are all going to say the knee on the neck caused it, and Chauvin's smug fucking face is still the first thing most people think when they see the video.
