The defense argued in the motion for acquittal that the State's witnesses have contradicted each other too much on cause of death and use of force justifiability to establish guilt beyond reasonable doubt. The judge dismissed the motion on the grounds that the law about these types of motions requires looking at the State's evidence in the best possible light. Since the jury could choose to ignore the weak witnesses and believe the ones who had a consistent testimony, he had to dismiss the motion.

Even taking everything the prosecution says in the best light they are nowhere near proving the 2nd degree and imo not doing it on the 3rd either. The manslaughter is the only charge that should have survived the motion.

motion to acquit has near zero chance of working once a jury trial has already begun. if such a motion is granted it goes against the entire point of having a jury decide the verdict instead of a judge.
