At this point I am somewhat convinced that Nelson did not push that hard for a mistrial just yet because he wants to see if the jury votes guilty. If they do then he will go for a mistrial through appeal, like you mentioned.

You generally have to preserve the issue for appeal which is why he raises these issues but doesn't always argue them very vigorously.

As the case stands you could make it go either way, depending on closing arguments IF the jury isn't tainted.
