Now that Texas has lifted their coof restrictions I wonder if Lemwaaah is huddled isolated at home because the coof can literally kill him.

It would be a tragedy if Lemon dies before the appeals are done. He was the weirdest and spergiest lawyer in this suit by far, and it would be a real treat if the chuppery gets reversed.
Bonus points if the TCPA only gets reversed on his clients and Marchi and Funi walk.
And he probably wouldn't get paid, because Moronica would have to foot the bill, not Vic.

It'd be funnier if the appeals came back in favor for Vic, and then he dies from a heart attack as he sees the opinion. He will go to his grave raving about cahnsluts and with the knowledge that he leaves his firm with two clients who owe $280,000.

The fact that it has taken so long makes me optimistic Chupp is about to get reamed. Let's not forget a few weeks ago one of Chupps decisions got completely overruled by this appeals court. And they were not precisely kind about it when they did so. This means they are already on record overruling him.
Next, if they didn't want to take this seriously we would have had the fuck off we don't care ruling. Which means they are working on something. And since they have gone past what their own deadline sets, whatever they are working on is most likely going to be crafted to set precedent.
Calling it now. Chupp is not going to just be overruled, he is going to be used as the example for how NOT to conduct a SLAPP hearing.

How much precedent is there to craft when the law in question here, the TCPA, is the old version of the law since Ty Beard got cocky and decided he'd still. win under this version and not the version that was going into effect not long after he filed the lawsuit which would've been even more beneficial to Vic's case. The TCPA case that was overturned, the one where Chupp thinks mean reviews on the internet are defamatory, was filed under the newer TCPA.
Some have theorized here that the reason this is taking so long is because the courts are busy and don't want to waste time ruling on a case which won't affect other cases (since there's presumably not many TCPA cases under the old law still active). Of course, their decision could still be useful to any TCPA cases in general.

Do appeals courts have any power to recommend a judge suck a fat one if they keep having to overturn them? Or would papering him be up to the lawyers he shit on?

It's very rare for an appeals court to do something like that sua sponte, that is, on its own motion, without a party asking for it. They can do anything within their jurisdiction, though, such as assign the case to another judge. It's very unlikely they'll actually do that, and it generally requires more than a shitty ruling.

If I remember, the changes to the TCPA wouldn't have substantially affected Vic. I think it just changed on how fees and sanctions were meted out, not how evidence was considered.

It made sanctions discretionary instead of mandatory, but this would possibly have only eliminated the smallest part of the judgment. Chupp, whatever else he did, did not seem to believe the conduct of the case was particularly sanctionable, although he didn't go to the full measure of, for instance, just granting nominal $1 sanctions, which he could have done.
