As soon as your bankruptcy is discharged you can get a new credit card. If you go through Chapter 13, which involves a structured payment plan to your creditors for 3-5 years before the outstanding debt is discharged, then you have to wait until the last payment is made. If you go through Chapter 7, like Phil did, it can be as little as 3 months until you are eligible for new lines of credit.My understanding is that he's ineligible from accessing money on credit from most financial institutions and credit lenders for about another four and half years now, so logically he shouldn't be using a credit card right now or asking any banks for a business overdraft or anything.
That doesn't really rule out that he can access money elsewhere if he really wants from some dodgy place that doesn't want to follow his bankruptcy terms, like some shifty credit union or a pawnbroking establishment that offers you pay day loans...
