Even if you wanted to give Chris the absolute benefit of the doubt in every possible sense of the word and assume that Barb groomed Chris in years past and therefore Chris thought it was appropraite despite Barb being senile, there's still so many other things to consider here.

Even if we try to attribute the most possible blame on Barb, Chris's crimes still invariably outweighs Barb's. Barb helped create the monster and I'm sure that she's done a lot of fucked up shit to both Chris and Cole over the years. However, Chris himself is an adult who despite his autism, is capable of understanding the concept of "this will get me in trouble" vs. "this won't get me in trouble."

Chris isn't an adult. He's mentally disabled and has serious learning difficulties which require proper management. You can't blame him for being retarded and acting like a retard, which is why we have support people so retards don't do these kinds of thing. Barb has always had an odd relationship with Chris and did things inappropriate with other family members with him. Chris doesn't understand boundaries and Barb encouraged Chris to have a too close relationship with his mother which for some reason turned sexual. Chris's lack of understanding and possibly Barb's mental state lead to some crossed wires and them fucking, which we don't know the details of yet. People are acting like Chris tied her to the bed and plowed her in every hole, when there's no evidence for who came onto who yet. Films like Psycho don't come out of no where, there's plenty of fucked up mother/son relationships out there which turn too obsessive and the son becomes a replacement husband. Barb was always put on a pedestal for Chris and held up as some saintly figure, he's been hen pecked since day one and is unlikely to have waited this long to fuck her if he was planning it all along. This is semantics but : Barb had long standing mental issues which are evident by living in a hoard, among many other things. She's isolated and probably malnourished, and living with Chris who believes in complete insanity.
You don't even even need clinical Dementia to be waylaid by those conditions.

*If* they can prove that Chris did sexually assault his mother - a big *IF*, because (despite what whiny crybabies on here think), it's not that easy, nor is it that easy to convict, (the ramblings of a lunatic are not sufficient evidence in the real world) - and they are willing to spend resources to take Chris to court to stand trial (when they could just cut out the middle man and avoid that expense) , then it won't matter if Barb has dementia or not.

Even if she's removed, it doesn't mean she has Dementia. It just means she's incapable of living in the situation given the extant circumstances.
