OR
She was too far gone to even talk to anyone and they made a formal decision to just charge the initial claim
 
If that's from a leaked recording there's a good chance that in itself won't prove anything because it might not be admissible in court.

I'm not sure why you would think that, as VA is a one party consent state.

Even if they weren't, the recording could be articulated to provide the reasonable suspicion that launched the investigation leading to the restraining order, leading to the medical examination producing physical evidence, with sufficient cause being found to compel a DNA sample from Chris, which would provide the probable cause for the charges.
 
You're completely wrong. His ramblings in the parking lot may not be very consequential but as the investigation proceeds and Chris' continues to insist he is a sonic/pikachu hybrid from another dimension his mental health could easily become a factor. As unusual as it is a plea of insanity does sometimes succeed, or a person with a severe mental illness may be found unfit to even stand trial. In either case the person will typically be referred by way of a treatment order to what is called a "forensic" mental health facility which is what we call asylums now that everyone gets their panties in a bunch over asylums. Technically the treatment order might say "make him sane enough to stand trial" but in practice that never happens. Insanity in this instance is a legal term referring to a person's inability to understand the nature and consequences of their actions, not to any specific mental disorder. If Chris consistently and believably displays a break from reality, there is a real possibility that he will be referred to the forensic system.

It is extraordinarily rare a defense of insanity succeeds. And when it does it rests on capacity. Chris seems entirely aware of what he has done, as he describes the episodes in detail.

His "ramblings" will in no way factor into his arrest or incarceration either, but may be a factor at trial. But see above. It is also exceedingly rare someone with even a severe mental illness (which Chris does not have in perspective of what the court might see) does not stand trial.

Insanity in terms of a legal standard, and insanity as you are defining it here and how we usually use it in everyday parlance are entirely separate.
 
20 pages ago it wasn't even a crime in Virginia. I'm going to wait for the actual sentencing..

Virginia also apparantly doesn't recognize transgenderism in what prison to go to if they're presurgery. So if he has to go to a male prison, why can't he be sentenced as a son?
All of this is, ironically, way bigger drama than Chris and his autistic life. The state lowering the level of crime because the defendant pleads he's transgender is groundbreaking stuff with implications way higher than a weirdo people on the Internet laugh at. Prison sentencing is night and day from the court process itself so even if it's law that pre-op stay with what they really are, it doesn't necessarily mean anything to how he's tried

I could see any of these three scenarios being the only options. They probably got physical evidence with a rape kit which got the warrant.
