As far as the evidence aspect, it's just dependent on if the ISP still has the logs from about a year ago. I assume they would, but I've seen crazier things.

All you really need to do is show "xxx bytes were uploaded to <site>" on this date/time. If those bytes are similar enough to the file, all that's left is proving WHO was on the uploader IP at that time. (This is assuming all the traffic was encrypted, btw)

That part, I'm not sure how you really prove definitively, outside of testimony along the lines of "Ethan Ralph was the only person who had this video".

If there is a decent prosecutor and the court really do want him to go down for this, he's fucked. With that said, my guess is that Ralph enters a plea and avoids jailtime, spins it as a win.

Despite Ralph claiming there were "no special circumstances" listed on page 1 of like 3 of the dispensation paperwork, and despite claiming the case wasn't nolle prosequi'd but rather was dismissed outright, I can now confirm to you lovely people that indieed, Ethan Ralph's charges for revenge porn for releasing the sex tape of Faith have been reinstated. His arraignment was held 13 August 2021, his next court date is 10 September.

Out of curiosity - couldn't his defense claim it wasn't "revenge" since from what I recall he released it to some buddies to brag about scoring with a young woman?
