If your trade secrets are posted all over the internet..then they are no longer trade secrets.

The problem LEGO runs into is in the Middle ground. They have to show pictures and product samples to the vendors a few months out from the release dates in order for everybody to generate sales orders and get stock on shelves for the holiday season. LEGO generally has 2 release cycles per year. Summer and Winter. These pics are from this years Winter release. Where they run into trouble is the shear speed at which Chinese Bootleggers can copy and release clones of their product. Lepin is or was the worst. LEGO actually won a lawsuit against them in Chinese Courts last year. And the Police raided and shut down the factory. In April But reports are they are already back up.

LEGO has to show pics and sets to merchants at the trade fairs, but they try to do so under heavily restricted NDA. The only way they can generally beat the bootleggers is to keep the pictures confidential until a week or so from release. The Disney Lucasfilms stuff has more complications because Lucasfilms enforces draconian street dates regarding information release. And that’s not Disney, it is how Lucasfilms has always been.

Good GOD, Lego is full of shit. I've been watching Lego's antics since about 1997. They do this EVERY YEAR. They "accidentally" have set images leaked that look like grainy shit, then they pretend to crap their pants with cease and desists all over (to get exposure), then "good" images come out a few weeks later, then all these sites are talking about THEM, long debates on "if we can post this".
I'm telling you, this is Lego's way of viral marketing, and has been for decades.

Those Lepin (and other bootleggers) on aliexpress are the shit. Their quality has gotten up, at times, to even be superior to Lego. You do still have some bumblefuck bootleg companies out there of poor quality, but there's not as many now. I can't even remember the last time I bought an "actual" Lego set that wasn't discounted to death.
 
Here's why, no matter what Lego does, bootleggers are only going to thrive and get better:

Ummm? Yeah, that actually is a major problem. The Chinese company Lepin is particularly skilled at it. They reverse engineer from pictures and flip them to released product in days. Really shitty product, but close enough in appearance to fool and flood the discount markets. They steal from LEGO. They steal from LEGO fans. They actually stole and released one of my designs.
If lego doesn't send a similar takedown to Chinese websites, then do they run the risk of losing intellectual property because they aren't "vigorously defending their rights" or whatever the phrase.

Lego needs to send a takedown notice to thisvid.com, there are videos posted of people doing sexual things to Lego man including scat.
 
One argument people have is, that Lego has to be this way due to the super-expedient chinese bootleggers getting their product out before they do. Only... Lego's been having these "leaks" / DMCA freakouts since the 90s, LONG before the bootleg game was even worth any sort of mention. The knockoffs have only really had their shit together in the past 5 years or so.
 
Would they be stupid enough to try and contact Disney over this? Disney could have reason to at least send an angry letter since there's a video in the griefing thread right now that Disney wants off the internet. If whoever snitched about the legos told them about the video, we may have the Mouse looming over us at any moment.

And former trade secrets enjoy no legal protection whatsoever. Unless you're the person who originally stole them or received them through wrongdoing, you can do whatever you like with such materials. Copyright still applies, but it isn't somehow more copyrighted just because your dumb ass let your trade secrets get blown.

Anyone who obtained them legally can still claim fair use.

As for the trademark claims, nobody here is claiming to be Lego and nobody would think this site was officially a Lego product. Nobody would be confused and purchase one product instead of another because of their leaks being discussed here.
