I don't play them, but if they're going after them it means it's definitely time to dip out of CoD.
They have no intention of improving if they feel threatened by fan works and their own older games.
They were distributing Activision IP. Not protecting your IP can have its own legal consequences.

I'm pretty this it still falls under this being an IP issue, even if it's tenuous at best. At the end of the day, this fan mod would compete with MW2, and Activision is already scared of losing their whales to remasters of their own games.I believe that only applies with trademarks.

Because the people who work within the industry are afraid of their own shadows.We'll never know exactly why, but large corporations have people on staff whose job it is to find pirate websites and send out C&Ds. It may be nothing more than these guys' number came up.
