Arguing insanity is an extremely desperate defense, it essentially frees the prosecution from having burden of proof which is extremely disadvantageous. Chris has already freely acknowledged Barb resisted in some fashion, and when friends asked him whether the allegations were true he was extremely evasive in his replies before eventually admitting admitting yes. Both prove consciousness of guilt in themselves.

I'm betting that the scenario hypothesized in the legal perspective OP is what plays out. He gets severe probation conditions as part of a plea deal which he immediately breaches because he has no self-discipline.

This whole situation started on lies about who he was having sex with, along with his previous knowledge of being it wrong and illegal, it wouldn't be easy to argue Chris wasn't aware of what he was doing at the time, all signs about this (from his own mouth and admission) says he knew it was wrong because he fought with the idea for awhile before deciding it felt right. In the end, nobody held a gun to Chris and made him do it. He acted in his own manner and had no reason to do so based on threats or blackmail.

america is known for our large prison population so him going to jail is a big possibility but our court system is fucking retarded so the chances of him getting off due to a technicality or mismanagement of the case is a big possibility too
