Typically police pull you up one one indisputable charge to get you into custody and then bring further charges later. In this case there's probably some strong evidence (like vaginal tearing coupled with Chris's own admission) for Chris having had sex with Barb, and then once he's in custody they can start laying out more stuff like proving she couldn't consent.

American Justice system is very unlikely to throw the book at someone in a declining state like Barb because it would likely fucking kill her. They commonly put elderly felons in Barb's age into Nursing Homes because there's just no point into further punishment since their Quality of Life is already so low.

At this point the state of Virginia considers Barb the victim, and that could only change if Chris broke down and revealed some horrific shit about Barb molesting Chris for decades which we know is very unlikely.
