Other bystander accounts (and the warrant) only state that he approached the group, got into an argument with one member (whilst reaching for his gun), and fired after they initiated the fight. Also, why wouldn't we conflate his content with this incident? He has a documented history of screaming "nigger" at niggers, and we know it's not just something he does for the camera because this all started after he used the slur during a road rage incident before his streaming career. The court's grave decision to charge him for ATTEMPTED MURDER tells me that the footage their outdoor surveillance cams recorded must be damning. There's no way Fox actually followed him down the street if the government felt it appropriate to level a charge that severe. They're not going to get that conviction but still.

I haven't watched the incident so im not gonna assert anything factual about it, but as for fighting words, what we're looking at is whether what he said was yelled in close proximity in a threatening manner or combined with a physical posture or presentation of a weapon in a manner that the court would determine could cause an "ordinary person" (this means if you were in their shoes not whether the nigger chimped out) could believe they were in danger. Also so.e of chuds online postings, could POSSIBLY be construed as a kind of premeditation for murder.
