Like any other big-city court system, they're probably really backlogged. So he gets scheduled for a hearing but they don't get through the 50 cases ahead of him so it gets pushed back again and again. It would help if we knew his exact sentence, which has never been posted, but if he got 6 months or a year, we're not close to being there yet. Then Dan's behavior would factor in---with his lack of remorse or understanding and vowing on video to stalk (er, "accost") underage girls again, there's no rush to release him early.
It doesn't seem like the exact sentence is known yet. The last 4 have all been probation and sentencing hearings. Could be just delays like you said. Maybe the sentencing has been challenging due to the fact that Dan is developmentally disabled which also gets factored in. If you look at the stages of cognitive development it is pretty obvious that Dan never made it past the concrete operational stage. I'll paste that in at the end. Presentencing a probation officer prepares a sentencing recommendation. That person interviews the defendant. I doubt it took them long to notice that Dan is retarded. Autism is absolutely taken into account during sentencing.
I imagine that it is complicated to even offer an alternative to prison for Dan since the conviction means he is a sex offender. Sex offenders aren't allowed to live within 1/3 of a mile of schools or parks in California. Something like moving back home with his mother might not even be an option depending on her location. Not that I think he should live with her. I said on here before I think the goal should be getting him back home. I think I was wrong when I made that statement. Since I wasn't taking something into account. The fact that Dan wants to have sex with his mom. I'm not sure an elderly, or near elderly, woman could deal with the potential issues of having him around. Remember he thinks parents having sex with their kids is nurturing. He may feel entitled. We've heard him discuss what happens with Kim due to his sense of entitlement.
It is all conjecture though obviously. Maybe some people will disagree but looking at the stages of childhood development I think it is pretty clear Dan is a 31 year old with the brain of an 8 year old. He absolutely hasn't reached the formal operational stage. He is incapable of logic. When he tries he ends up saying things like it is probably healthy to lick assholes due to probiotics in the colon. That or he ponders if a 13 year old recorded himself having sex with his mom would it be considered child porn. The examples are endless and kind of pointless I suppose. Anyone that thinks Dan is capable of logic is likely just as developmentally stunted as Dan. So it is either obvious or falling on deaf ears.
Here are the four cognitive stages of childhood development as identified by Jean Piaget:
Sensorimotor Stage: Birth through about 2 years. During this stage, children learn about the world through their senses and the manipulation of objects.
Preoperational Stage: Ages 2 through 7. During this stage, children develop memory and imagination. They are also able to understand things symbolically, and to understand the ideas of past and future.
Concrete Operational Stage: Ages 7 through 11. During this stage, children become more aware of external events, as well as feelings other than their own. They become less egocentric, and begin to understand that not everyone shares their thoughts, beliefs, or feelings.
Formal Operational Stage: Ages 11 and older. During this stage, children are able to use logic to solve problems, view the world around them, and plan for the future.
