I think DSP has a case against Raw Phil and Raw Phil alone. What I don’t think he has is a clear path to damages. How can Phil claim that people on a channel made to mock him would have given him that money instead? They already had that chance and chose to sub to Raw Phil. Raw Phil does not prevent people from tipping Phil.

Phil probably could get Raw Phil taken down, but is it worth the time, money, and effort when he'd still have a bunch of other transformative restreamers parodying him? Even Phil knows it's not, which is why he's talked about it for 15 years but has never done shit.

This is the big thing. Channels getting taken down for copyright reasons is super common. Think about all the streamers who got in trouble for licensed music and what not before video games started offering safe for stream options. Or less innocent examples, people that blatantly upload TV shows/movies for people to watch. They tend to get caught pretty frequently, but they simply get taken down. Heck, even in some of the "bigger" cases, they rarely sue for damages, they just want the content taken down.

Not all lawsuits are about getting massive settlements, going against RawPhil would basically be nothing more than a cease and desist. I don't think the channel is even monetized, and while the channel ultimately gets more views than Phil, it's still tiny numbers by YouTube standards, not enough to amount to any significant damages for a lawyer to care about, since their payment tends to be a % of whatever their client makes + general legal fees. Something like this would basically be a waste of time.

Realistically, if a lawyer was smart, they'd charge Phil $500 to have their paralegal take 5 minutes to produce a generic cease and desist form. Raw Phil would go down...and then probably be back up as Raw Phil 2 or Immortal Raw Phil or something in less than 24 hours.

But yeah, as others have said, Phil isn't actually doing any sort of lawsuit. It's hardly the first time he's talked about it, and it's certainly not going to be the last, but like with all the other times, Phil won't even look at contact information for lawyers.

The thing is phil broadcasts himself on the internet for free. This isnt like rebroadcasting a movie that you would typically have to pay to watch. The restreamers are taking a free broadcast and also broadcasting it for free. Phil would likely have an argument to get raw phil shut down but that's likely all he could do, there wouldn't be any damages because its just a free rebroadcast of a free stream.
