I'm not super knowledgeable, legally, but this seems like exterminating a mosquito with a surface-to-air missile.

Acerthorn's lolsuits are currently at 0 for 99, the courts are sick to death of him, know he's full of shit, and Acerthorn has the legal acumen of a goldfish with down syndrome.

Seems like getting some high end lawyer will assure victory, but so would being represented by your friend who owns a suit and has seen three episodes of law & order. Unless god himself opens up the heavens to fuck with us all personally, David isn't winning this case.

And as for a counter-suit, sadly, no court is going to make him give anything, as much as I'd love to see it, because he has nothing. A computer, a broom, a broken down truck, a filthy mattress. David is already living in the fail state he deserves. Destitute, worthless, alone, disliked by everybody who knows him.

Null is dealing with this kind of shit with Russ and Melly for years, on his own and without the kind of support and audience Sid or Jeremy have. I'm a bit surprised they present Dave as this serious threat to free speech, he's even more retarded and inept than our previous liticows.

You never want to lowball a potential court filing, even if the retard is absolutely aspergs about it.

What if the motion goes unchallenged? What if the judge sleeps at the wheel? (Or as the weebs lile to call it, chups it up)? Would you want to get a foreclosure on your stuff just because you didn't say "Hey, that's bullshit!"?

You don't fuck with the law. The law will fuck with you.

Though I want to say that there is no point in countersuing besides filing a motion requesting the court to consider labelling Acerderp a vexatious litigant and demanding him to file any new filings with a lawyer on board. Any sue back for fees will hit a dry well infested with roaches.

It's more to prevent a precedent where some idiot wins a court case despite fair use. If that happens, it opens the doors for other malicious (and possibly not autistic) actors to sue people for things that are fair use and using Acerthorn's court win as precedent.

In other words, it's about sending a message.
