Technically. Many Civil Law countries treat "insults" as criminal offences on paper. One thing to consider is that those laws are really old. Like, early-19th-with-roots-in-18th-century old. Some of the definitions have very archaic wording, along the lines of, "that which harms one's honour and standing".

Most importantly, these laws tend to pre-date the introduction of proper constitutions and rights. So, in practice, constitutional guarantees of freedom of speech have all but overwritten these laws in many instances by taking precedent. What's "insulting" is ultimately subjective, and a judge faces a conundrum when he's confronted with a statement that is both true and insulting. Nearly all will err on the side of caution and stick to the constitution. That is, assuming the case even makes it to court. Obviously, a criminal complaint boiling down to, "X called me a poopiehead" are not going to be high on an overworked police force's priority list.

The one notable exception to this trend are police officers themselves. Many Civil Law law systems actually list "insulting an officer in the line of duty" as a seperate criminal offence, along the same kind of logic that they're representing the law and justice that justifies contempt of court charges. Practically, it's an excuse for cops to throw the book at particularly annoying and/or not technically law-breaking arrestees. Think of it as similar to how charges of "disorderly conduct/disturbing the peace" often work (which, conversely, is a very Common Law concept that many Civil Law countries don't have a real equivalent for).

Interestingly, it seems Germany does not have this provision. Werner was charged and convicted of 'Beleidigung' full stop. Like others have said, he's been flinging insults at the popo for fucking years at this point. If German law enforcement really cared that much about insults as a criminal matter they would've cuffed him after the first 911 call. It's very obvious they're throwing everything that'll stick at him because they're sick and tired of his antics.


That's the crux of the issue: if you go out of your way to escalate a situation, then you have now become the aggressor. The parameters of what constitutes 'self-defense' don't even matter, because what you are doing can no longer be reasonably said to be self-defense.

It's no different in the US, despite what some future Boogies might tell you. You brandish a gun for the sake of brandishing, you done goofed. You flee from a confrontation only to return, you done goofed. You fire off a 'warning shot', you done goofed. You put a round in someone the second after it can be proven he was a credible threat to your person, you done goofed.

I think it might date back and be a hangover of a culture that traditionally placed a high value on honor, which was very important historically in Germanic societies, and was something that people would often literally kill for, both in duels (I believe some German Universities still practice a form of this, right up to the mid 20th Century, where duelling scars were seen as badges of honor, I can't remember the name of it.) and going right back to things like the Holmgang practised in the Dark Ages.
In societies that put such a high value on honor, an insult could literally be deadly, so legal codes that punished that sort of thing were an attempt to mitigate the loss of life that would otherwise be caused when bloodfeuds were the alternative.
These laws are likely very old, and often legal systems are slow to update (interestingly, there was still a law on the books until very recently in England that if you spotted a Welshman on the streets of Chester after midnight, you could legally shoot him with a longbow.)
so these things stick around.
The US is a very young country compared to Europe, where their laws go back hundreds, and sometimes a thousand, years.

Because of the occasion, I went through some of his old stuff today and it's crazy how much worse he looks now. Way at the beginning he was certainly fat and looked like your none-to-bright metalhead but he looked pretty normal. In comparsion to that, he's a total wreck now. He even sounds more unhinged. no Rainbow from me since many here have expressed similar sentiments. None of us believe that Rainer as he is now is a good person. Nobody here believes that somehow he will come out of prison one either. But some here have distinct hope that after prison he is simply in a state where he realized that his life before was utter shit and realizes that it wasn't always everybody else's fault and changes something big. Yes we might lose a Lolcow in that case but dear god he really needs to learn that fast. As the judge stated it perfectly (in different context) "Die Uhr ist 5 vor 12" for his health, life and now criminal history

While this is likely to be appealed, Dragonlord has been sentenced to two years in prison with no chance of probation, due to multiple counts of insults and infliction of bodily harm/assault (towards visitors).
He had previously been sentenced to 7 months probation for pepperspraying a visitor.
Originally a verdict was expected on the 28th (two days were scheduled) but they got through it in a single day.
The defense asked for 2 years on probation (citing Dragonlord's willingness to move and lay low, having recently sold his decrepit ruin house which he will move out of in January), the state asked for 2.5 years without probation. Judge "compromised" on 2 years without probation.

A couple of explanations as to his background and pre-youtube existence that may not have been covered by Dankula can be found in the previous pages, where the Germankiwis have been switching to English in anticipation of this event.


To clarify : Insulting people publicly (or disseminating insults through a public medium) is punishable under German law. Rainer regularly insulted the police and individual policemen / patrols in his streams when they did not arrive fast enough for his taste (he would call them multiple times daily, basically whenever someone visited him and expected them to show up within minutes)
