But since the court knows, that his visitor know, that if you provoke him enough he might do something funny / stupid / criminal (depending on the degeneration of the visitors in question), he got away with a lighter sentence as far as I read in a protocol written by a court visitor.

Well, just because you have some form of retardation you don't automatically get some form of compensation. Rainer being officially diagnosed with a mild retardation and not getting any benefits is tonally within in the means of the welfare system.

For example in Rainer case:
He would have to apply with his local authority for benefits (Schwerbehinderten Ausweis - disability licens) with the actual disability listed and the deficits in his day to day living. He then gets "points" according to grade and his deficits and tardation. With a low score he would mostly be able to get a tax deduction but since he doesn't do his taxes or even pays taxes, this is totally worthless for him. He won't get any special benefits like disabled parking just because he is a mental midget.

Other ways of benefiting, like care allowance (Pflegegeld oder ähnliche Pflegeleistung) he won't be able to collect since his tardation is not severe enough.

Hab grad nen Jurastudent-Gumbel von mir dazu gefragt und er meinte auch dass das wohl ein Fall von Sperrberufung seitens der Staatsanwaltschaft ist.
Das Jurabeerchen geht in Berufung um Druck auf Rainers Anwalt zu machen. Nach dem Motto. "Schau mal wie dumm sich dein Klient benimmt, wenn wir in Beufung gehen bekommt der nun sicher mehr als 2,5 Jahre also ist es besser für dich das Urteil anzunehmen"

Kann man nur hoffen, dass der Dicke trotzdem auf Berufung besteht (immerhin hat er das letzte Wort und er kann im Falle der Berufung auch darauf bestehen, selbst einen anderen Anwalt zu bekommen)... Wäre einfach zu komisch, wenn er malwieder in perfekter Beratungsresistenz vorprescht und sich dann dadurch 3 Jahre Knast einhandelt.

well i didnt say he was aware of that mechanism, he only acts on emotions so for him it just makes him agitated to accept a prison sentence so he will do whatever to fuel his hope for getting out of it unscathed. Hes pretty much like an animal in that regard
