I know this is the least news worthy thing to keep arguing about, but do you realize how demented YOU sound making this idiotic argument?

Oh we saw video evidence of an elderly woman's cognitive decline for years, but all that goes out the window because she had enough mental faculties to crash a car so bad she totaled it and nearly killed herself and others, leading her family that hates her to finally take an interest in her life again before she actually does kill herself and or someone else. That's evidence that she faked everything else for years, including passively taking abuse on and off camera and allowing her property to be destroyed, because she was smart enough to crash a car! You can't have it together enough to crash a car, and have Alzheimer's! If your 80 year old grandpa crashes his car, don't take his keys away, because having the wherewithal to crash a car is a sign that his mind is sharp as ever.

We can just shut down psyche evals at prisons and asylums. All we need to do is lend cars to people staring into space mumbling to themselves, and if they crash the car then they're totally all there, because how could someone with a failing brain crash a car?

I think this is the worst thing that can actually happen to Chris. He's still a child mentally and depending on what tier they put him on. It's going to fuck his life. No more gamestop, no more parks or public areas, no more cons, etc. Being the ignorant dumbass he is. He's going to break it and be confused as all hell when the police arrive (we all know weens are going to be stalking him just to report him) he won't understand what he's doing wrong, or believe it's not, and life will be hell on earth for him. Then again, all he had to do is not fuck his mom.
Even worse, he simply had to keep his motherfucking a secret. If he hadn't blabbed about it he could have gone to the MLP convention.
 
I wonder if it's possible that by the end of this, Chris is going to be stripped of the Autism diagnosis after all this time and be slapped with something worse sounding. I certainly would be interested to see what would come out of sticking him in a CatSCAN machine and looking at his brain activity as compared to somebody with high functioning autism that didn't turn into, well, Chris.

Also, I missed if anybody had the answer to the question about the tugboat, but doing a brief reading of SSR 83-21, it sounds like the Tugboat will be suspended for as long as Chris is in jail for the felony. So he won't even have 'backpay' to look forward to once he's out.

He won't be in jail when he's convicted of a felony. He'll either be released (probably with a suspended sentence rather than just time served, although it's still possible for just time served tehcnically), or in prison. The suspension only begins once he's convicted. Theoretically he should be receiving his tugboat right now.

What are the odds he's sentenced to something greater than time served at this point? I understand that's an extremely tricky question, but if you had to put five bucks in a pool for guessing the sentence, what would you place your money on?

Like if he claimed he murdered 6 people because sonichu told him to do it and there was actually bodies found and strong evidence he actually did it, the insane ramblings about alternate dimensions and cartoon characters would make it obvious he's out of touch with reality and could actually do something like that.

Neither of them got off on insanity. You have to be seriously seriously delusional for that and Chris is nowhere near insane enough to qualify.

I was looking around for examples in the US - most people who have committed this crime, it was by a parent on a minor child, so they get slammed by rape charges on top of it. I could only find a few where it was "only" incest between adults, but Barb's diminished capacity (if she meets the definition legally) might come into play.

My prediction - 1-3 years with 2 suspended. Chris has to register as a sex offender for 15 years. But Chris will fail to get his name removed from the registry (you have to petition the court in Virginia for this) because he is Chris.
 
So he had 2 evaluations from 2 psychiatric institutions (Western State is also a psychiatric hospital)?
Is it likely that Heilberg tried to get him to be labeled as unfit or too retarded for trial? Or would that be at Chris's own request?
It looks to me like the first evaluation said that Chris was fit to stand trial, but he wasn't receiving the correct meds. They sent him to the second nut hatch to get doped up and stabilized.

The fact that the Grand Jury is only considering felony incest, not rape indicates that there is already a plea bargain under discussion. The prosecutor would have tossed rape in there too to give him a charge to drop if Chris had rejected a first plea offer.

This is similar to the example of insanity we learned in law school. If you have a mental disease that causes you to actually see and hear aliens, and they tell you to kill a person or they will destroy Earth, you can't plead insanity because you would still understand that you are killing a human being, which is a crime. You understood (or were able to understand) your actions and the effect they would have on the victim would constitute a crime.

If, however, your mental illness caused you to actually see and hear the victim as an alien threatening to destroy Earth, you might be able to plead insanity. Because you actually couldn't comprehend the victim as a human, but rather as an alien (who, under the law you theoretically could kill because murder laws only apply to killing "persons") you didn't understand (and at the time were incapable of understanding, due to your mental illness) that your actions constituted a crime.

And an insanity defense is different than being found unfit to stand trial. That has more to do with your current ability to understand the charges against you and effectively participate in your defense (a low threshold). Chris was evaluated for his competency to stand trial, and apparently was found competent or rehabilitated to competency. He is not legally "insane."

A lot of confusion stems from the 70s and 80s where the standard for insanity had more to do with whether or not your mental illness heavily influenced your crime, but after some notorious cases the feds and pretty much every state introduced a higher standard.

I went googling to find out if there have been any other class 5 incest cases in Virginia. I found a case about a guy named Steven Pladl who had a baby with his own daughter. I went to google up what he was sentenced and found out that he finished the case with a shotgun.


Took his daughter and daughter/grandbaby with him.

He needs to be kept on the sex offender list for life no matter what, whose to say he wouldn't justify it with another elderly/handicapped woman in the future. I can't see any scenario where he doesn't end up on the list (some people earlier were saying the he wouldn't).

I think the prosecutors probably made that a condition for any plea; don't think there is any chance they would allow him to plea and NOT register.
