NASHVILLE, Tenn. (WTVF) — Saturday morning, Metro Police Chief John Drake took questions from reporters, following a fatal shootout involving one of his officers.

Nika Holbert died from her injuries Friday, after Holbert and Officer Josh Baker exchanged gun fire in a Dollar General parking lot on Brick Church Pike.

"I’ve reviewed the body cam footage, he appeared to do everything he could to try to de-escalate the situation, including the use of taser, including trying not to use his firearm," said Chief Drake.

The morning of the shooting, Officer Baker pulled over a black Chevy Camaro after running the plates through their system and seeing that the owner of the car, Demond Buchanan, had six outstanding drug warrants. Baker quickly realized the owner wasn't behind the wheel.

Instead, it was Nika Holbert. Body camera footage released by MNPD showed Officer Baker found drugs in the car, radioed for backup and attempted to take Holbert into custody. That's when everything escalated.

"Here do me a favor and turn around," said Baker.

"No don’t put me in handcuffs I haven’t done anything wrong," replied Holbert as she ran away from the officer.

The video shows Baker warned Holbert that she was about to be tazed. When she retreats back into the car, he deploys the taser. Then you can see Holbert reach for something with her right hand. Baker believes it's a gun. "Ma’am, put the gun down, put the gun down," Baker screamed.

Holbert and the officer then exchange gunfire. Metro Police say Baker was shot once, Holbert was shot twice. She then attempted to get away, only to drive the Camaro into a ditch. Holbert later died from her injuries.

"There’s nothing else he could have done better other than maybe leave the scene and let her go away, and obviously, he couldn’t do that," surmised Chief John Drake.

Drake says Baker couldn't let her go, because he found her to be in possession of drugs and because she was driving without a Tennessee's drivers license.

Nika's Mother Responds

Nika Holbert's mother thinks it should never have gotten to this point. She called NewsChannel 5 wanting to share what she believes is her daughter's perspective on this story. She has asked us not to use her name in the interest of her own safety.

"There’s a thousand scenarios that could have happened to where both of them could have walked away. My daughter should be alive today," said Holbert's mother.

Nika's mother tells NewsChannel 5, she does not know the owner of the car her daughter was driving. "If I did, I would have him arrested already - yesterday. I don’t know that guy," she added.

She also said she wasn't surprised that Nika pulled out a handgun, saying she was quite obviously scared. “He was trying to kill her with that taser and she was trying to protect herself," she said.

Holbert's mother is now in the process of hiring an attorney and is considering her legal options.

Latest on Officer Baker's Condition

Chief John Drake visited a wounded Officer Josh Baker Saturday morning in his hospital room at Vanderbilt University Medical Center. "He was in a little bit of pain still, understandably. His stomach had been -- he had a procedure done so he was a little groggy still," said Drake.

The 14 year veteran of the force could be released in the coming days.

The Tennessee Bureau of Investigations is still looking into the case, but it will ultimately be up to District Attorney General Glenn Funk, if any further legal action will be taken.

Any time someone tells you the US has an overincarceration problem, look at any random rap sheet. You'll usually see pages and pages of dismissals, suspended sentences, and deferred adjudications before someone is sentenced to and actually spends a single day in jail.

She didn't, but she had two bags of weed, was driving without a license, and was in possession of a firearm while transporting narcotics.
She was looking at Federal time for that last bit.

Yeah, she would've been fucked for the firearm charge. Driving a car without a license is pretty risky, that's why if you're going to do that, you better make sure the car has clean plates.

She did just about everything wrong that she could have, the cop was lucky she didn't kill his ass the moment he took her bag and turned toward the back of her car.
If she was slightly more decisive fatboy would have died on camera and been a training example.

This is what happens when we demonize the police and punish them for doing their jobs. This guy almost got killed because he was being way too lenient with this bitch because otherwise he'd be an evil NAZI WHITE cop arresting a black woman for NO REASON. And all these retards have said the police simply need to tase everyone instead of shooting them, and when they do this happens and they get accused of trying to kill them with a taser.
I don't know how easy it is to defend against a wrongful death case, but man if I was the city and going to pick a case to fight, this is the one to fight. I'd fight them every inch of the way as I think the evidence is well laid out that the death is anything but "wrongful".

The situation had "1000 opportunities" for the kween to go home alive, albeit with a few extra charges, and at every on of those 1000 crossroads the kween chose the wrong option and the cop chose the right option at least from an optics and narrative perspective.

There is no demographic that outright REFUSES to follow ANY rules of the road, including parking and paperwork, and then feign confusion and cry racism when called on it quite like Tyrones and their sheboon girlfriends. They see the vehicles code as rules for white people and they're too cool/smart/entitled/with the hustle to have to be bothered with following those rules, after all, they're enforced by police and that means they only get pulled over because of racism, even if they blow 4 red lights in a row, they're convinced deep down inside that a white person could do that and nothing would happen.... therefore, since traffic laws are racist, they are going to fight the cop every step of the way, and if need be, with a gun, it doesn't shock me at all.

We routinely tow abandoned clunker cars off main streets where they've frequently been left blocking driveways/businesses in addition to being streets were parking isnt' even allowed in the first place. Wanna guess what the owner's race ALWAYS is?

There's a car that routinely parks on the street in front of the convenience store where I grab my breakfast. I see it every morning. It's a hooned-out late 90's Honda, with no plates. Not temp plates, not dealership tags, just NO PLATE, at all.... it parks in a spot that's clearly marked NO PARKING AREA and has a fresh ticket on it every morning from the Borough's parking enforcement guy.

Wanna guess the race and sex of the person I saw get in it?

Wanna guess what she'd go to Facebook and cry about if she gets pulled over for driving around a car with no tags and likely delinquent tickets?

The records show they are misdemeanors. Maybe some of the misdemeanors are actually infractions and they can't code them correctly, I don't know, but I don't think that's pertinent. The salient fact is that she kept racking them up year after year, for almost a decade. That tells you something about her personality, about her willingness to follow the law and/or her ability to learn from the consequences of her earlier mistakes. (That they were nonexistent.) To me, this is more concerning than would be a single violent felony or a period of drug addiction with clear rehabilitation. This is someone with an unreformed, perhaps incorrigible, criminal disposition. Maybe if she had actually served some of that time in 2012, she could have gotten some therapy or life skills coaching. Our penal system isn't completely useless, some inmates actually benefit from the programs they offer. "Go forth and sin no more" clearly didn't help this woman.

Pretty interesting that she's actually fairly compliant with following orders and the officer is pretty chill for most of the video, it's only when he wants to handcuff her that she starts panicking and flips out. Tasering her in this state was probably a bad idea, since she seemed borderline convinced that he was trying to kill her and as someone who knows a thing or two about tasers, having it pressed up into your arm like that actually does hurt so bad that it feels like you're dying. Which makes her more agitated, she shoots him and he fires back. She dies, he lives.

Point of no-return was the request for her to get in position to get cuffed. Like, it's borderline bizarre how terrified she was of it. Officer didn't really do anything wrong, it's not like he was threatening her.

Other than being fat, the only thing he did wrong was not handcuffing her the moment he had an arrestable offense (the drugs in her bag) in which do to so.

This actually a sleight of hand by her and she's good at it; she is violating orders so sure-handedly that she looked like she was supposed to be doing what she was doing even though nearly all of the things she did involving her bag are major safety red-flags or direct insubordination, just extremely chill insubordination. Re-entering the car to "look for the lighter" when he said "I'll get your lighter" is the point where if I were in his shoes, I wouldn't wait any longer, the cuffs are going on as at that point.

The entire video is a great demonstration for an "officer safety" nut, because so much happened between initiating the traffic stop and her getting tazed that should be setting off red flags and at least result in verbal reprimands when the instances happened with demands to follow directions exactly.

For my statistics class recently, our final project was crunching data on police stops. I can't speak for other areas, but the city we studied in the South showed no significant bias against black people.

One of the data sets was whether black people are pulled over more during the day (since you can more easily see the driver's race during the day than at night), and they weren't more likely to be pulled over during the day. Another data set was whether searches of the vehicle found any contraband. Black drivers were more likely to have contraband than other races.

If anything, hispanics were more likely to be unjustly discriminated against when you look at that data, especially the contraband data set. Considering some hispanics pulled over might have been illegal, more unwarranted searches might have been due to fearful behavior because they were worried about deportation.

Like you said, maybe black drivers get pulled over more because they break more traffic laws.
