For today, Legal Mindset promised a very very significant update regarding the Johnny Smally case.
Partial recap/ some notes from that stream:
- trial date was moved (it had been scheduled for April 9), Smally's public defender in the Western district asked for it. Will likely be granted. It's for his plea hearing (where he pleads guilty or not to charges).
- JS streamed a legal meeting with his lawyer; stuff was said in Korean, that he didn't understand of course.
- Hank, on whom he relies for housing, is running out of money
- JS didn't want his whole legal plan to get out, but it was leaked
- he has a public defender in the Western district, a paid lawyer in the Eastern, who isn't registered in the other one so doesn't know what's up. Hank is not of help with that. Hank (his family) pays for that lawyer.
- paid lawyer gave false advice, because he was unaware of the deepfake (sex crimes) in the other district. People who can understand him, say that he sounds like a strip mall lawyer. Inexperienced and not aware of the full picture of JS's deeds
- Hank understands himself as legal counsel for JS (although he has no education and lost all his court cases in the US and got deported). He poses as the translator for JS but is a really bad one, he doesn't do it correctly, so JS doesn't get real info. Hank doesn't take the cases seriously, he puts his own spin on stuff when translating.
- Hank's family is cutting him off
- JS caught a new sexual charge against women and children, which is already at the prosecutor stage
- his cases are being handled by a police superintendent, not only a sergeant as usual, so at a high level
- the police departments hate JS
- he got a female prosecutor, which is one of the top ten prosecutors in the country (!) "Oh no, it's a woman!" he said. He is known to harass women, children and the elderly or disabled.
- his lawyer tried to meet with her to drop the deep fake case. It was too late for that.
- TIL that South Korean law is based on German law.
- JS indeed tried to flee the country and failed! in October
- paid lawyer told him, that he can't go to prison for deepfakes, "because he is American", which is wrong, there are cases like that where it happened
- multiple victims came forward in the deepfake cases
- Hank thinks the law is ridiculous. Which isn't really a defense.
- legal strategy is to blame the victim
- finally a charge or two for his disruption in Lotte World are coming in.
- next charge, if it comes in, would be with mandatory "labor" punishment: Police is investigating "child sexual harassment". It's been referred to the prosecutor for serious consideration already. JS knowingly went to a line in that amusement park with kids, noticed kids, let his text to speech blast sexual messages relating to
sexual acts with children, in Korean language. He did that elsewhere too, screaming that he wants to have sex with children.

--> The prosecutor won't be "cooperative", it would be RKI who should be, but isn't and hasn't been, he instead insulted police officers and the prosecutor.
