No. Transgender inmates have to petition the warden for a transfer to a women's prison and if the warden denies the request then they'll have to appeal to CDCR's Secretary - the head of the department. And if the secretary says no, then they can start a nice long appeals process through the courts.

"Trans" inmates can't even get a diagnosis of gender dysphoria and HRT without a year of GD in their medical record.

As I said, it may be the law, but prison administrators know how to make policy they disagree with work in their favor anyway.

Much appreciated. Maybe it's off topic but now my interest is piqued; how are the living conditions as an inmate (patient?) having been committed to a mental health facility compared to a regular prison?
I can't speak for elsewhere, but in California they're the same. Seriously mentally ill inmates get sent to state hospitals. JY is not seriously mentally ill.

A situation where a person is sentenced as a male and seeks to transition while in the Corrections system is Very different than a person who is before the courts as a woman, and is sentenced as a woman.

@moseph.jartelli it is often useful to read the entire context of a thread to understand responses. There was a dialog going on for a few pages, and understanding that would illuminate the context of my reply.

Open question: why do people here seem to think responses are somehow emotionally driven?

No rational adult lets random, anonymous strangers impact their emotional state or esteem. I wonder if it might be projection from people who's peer group and social interaction comes primarily from internet boards... I can't imagine how lonely that must be.

JY is likely going to end up with some court ordered counceling and possibly some fines. Nobody is going to put his fat ass in prison because of the various autist on autist slap fights. If just because tossing Yaniv in prison is a cruel and unusual thing to do to the other inmates. Not even murderers and rapists deserve that.
 
@REEEEEEEEEEEEEEEEEEEEEEE! Up here, Correctional Services Canada uses the term "Institution" for prison. They're synonyms here.

Per ShortStack's question about getting JJYS into a mental hospital, or committed to a mental health facility, I wrote a fair bit about why that is nearly impossible in the case of JJYS.

Basically in BC, much like the rest of Canada, it is pretty hard to get someone committed against their will for longer than 48 hours. I provide quotes and links in a previous post somewhere in the Yaniv section of the farms if anyone feels like hunting.

As for the poster that says Yaniv is unlikely to receive a custodial sentence for his crimes (thus far), they are absolutely correct. I've pointed out numerous times that speculating about Yaniv being given a custodial sentence is, at this juncture, pure fantasy.

As for the speculation about where he would serve his time if he were to, one day, be sentenced to prison... He's a woman in the eyes of the law. End of discussion.

I think this conversation occurs about every 10-15 pages.

Finally, with regards to @Hyacinth Bucket (Bouquet) saying this isn't worth getting angry over.. I don't think anyone is angry. I certainly don't read anger into the comments of people who don't understand a topic or concept.
FYI. Sources tell me that there is a possibility of getting a 30-day NCRMD/Fitness done, in-custody, at the nearest facility. In fattie's cases, that would be Port Coquitlam and their in-patient hospital.


But I seriously doubt it unless he gets into some real trouble. Just remember that this is an option. Given that it's a 30-day hold, it might reveal some interesting details about his lack of menstrual capacity, and mental capacity.

It's a long and slow-starting story but it gives you alot of insight into the social structure of American high-sec prisons, and has some pretty funny moments.
