Even in the most obvious cases it can take weeks, even months at the earliest, to get a problem homeowner removed from the premises because it requires that the unit be forcibly sold. There's no mechanism to remove anyone as a homeowner as long as they still own the property, so probably what the HOA will do is nail her with tons of fines she can't pay and then put a lien on the property for unpaid fines

That's what I'd do anyway, easiest and fastest way to get rid of a problem tenant or owner is to nail them financially because courts don't take emotion into account with finances, its not "so this made you feel bad so you're trying to evict?", it becomes "Mr. or Mrs. So-and-so, did you or did you not pay your fines that they have proven they can charge, per the CC&Rs and the evidence provided?"

Edit, this applies to the US so Canada might be different but I doubt it

Criminal and civil remedies are a clumsy process, but it’s legally almost impossible to simply make a particular owner sell or move out. A combination of specific strata by-laws, intervention orders, criminal sanctions, mental health interventions, and CCTV and eye witness evidence and effective action by authorities can make it almost impossible for the owner to continue to live in the property but apart from debt recovery for unpaid strata fees there is no legal pathway to kick someone out.

This is exactly the type of situation that lead to a deranged owner killing 5 members of his condo board in Toronto.

I dont think there is much recourse in shared building owner co-ops - In the Toronto case, the council was starting to win a legal case against the shooter, and were hoping to ask the judge to force him to sell and move out.

Yeah you can't force someone to stay away with a criminal order, at best you can get an RO but that just prohibits Miriam from interacting with specific individuals, you can't bar her from the property as a whole like that (not for lack of trying I'm sure)

Of the items you've mentioned, the by-laws are the best chance at getting her out because (provided hers allow for it) they can fine her to oblivion, charge her for said fines, and then when she doesn't pay start the process of applying a lien to the property (again, if the by-laws allow for it) and then force a sale to pay for said fees (including legal costs). The property's proceeds are still hers after the fact but the lien on the title means any transaction through title will get them paid, and its an awful hard road to try to private sale a property without a title company to handle the bullshit

My assessment of Miriam, based on nothing more than having worked around people with dementia, is that she is experiencing neurological decline, and this is exacerbating the aggressive and irrational sides of her character, which have always lain close to the surface.

Long before the strata have worked out an exit strategy on her behalf, she will be resident in a care setting. That is assuming the possibility of MAID isn't put on the table as an option by emissaries of Canada's bloodthirsty healthcare service.

The Folie à deux that is the bony-fingered, red-nosed Miriam, and her ogrish, pear-shaped mandaughter, embodies a peculiar stability, where their behaviour is anti-social but predictable; of late focused on their respective strata. It is nice to see mothers and their children spending time together in the pursuit of a shared hobby.

Absent the 'stabilising' influence of Miriam, which will leave her friendless jellyfish offspring socially isolated, I think that we might see the unwelcome return of flailing, paedophile Yaniv.
 
Per Meow Mix, Miriam is banned from her building and may not even be allowed in JY’s condo. These are the conditions of her release:

- she can’t contact Gina or any other residents of her building (with the exception of her sister).
- she can’t be in the same place as Gina.
- she can’t go within 200 meters of her building. JY’s building is within this radius, but she has no other relatives to stay with.
- she can’t possess any explosives, lighters or incendiary devices.

Seems she was seen Monday evening in JY’s car across from her condo, suggesting the psych stay didn’t happen. The sister is taking care of the dog.
