No..again, this is a conditional discharge, not a conviction. If he violates his probation, or commits an other offence, the charge will likely be converted to a conviction and he will have a criminal record.
There will need to be a few more criminal convictions, or a severe charge and conviction, before he will receive a custodial sentence.
People need to understand that Canada doesn't have the same culture of incarceration that the USA has. The Farm's prison fantasies will have to wait a lot longer

The most likely path to custody for JY is something that has a mandatory minimum sentence. If he is convicted of impaired driving twice, the second conviction carries a mandatory 2 week custodial sentence, for example.
In the case of JY, in can imagine a posession of child pornography conviction. Those have a mandatory minimum of 6 months in jail. However, they're a bitch to prosecute, and I think JY is already attempting to sew seeds of doubt... -can't get an erection your honour. -people have sent it to me, it isn't mine, I've even reported it to the RCMP. -I am being framed by KS/DS. We have a lengthy history. I would wager on this gambit 100%

Masks can have sizes, especially home made masks where the sewing patterns are different sizes for men and women. I would not be shocked if he was wearing a women's mask that is too small for his fat head.
