Even if it's not against the law to release the info, can we just not do that? They count for HIPAA because working there we are their case manager support which involves mental health even if its just behavioral support.

Larger boarding home style ones will even have a 24/7 nurse support and therapists and case managers on staff.

And in both settings the case managers know the diagnosis of their clients and yes we refer to them as clients because that is what they are we are watching them to keep them mentally and physically safe. You even have to do nightly case notes.

It's becoming extremely common for housing for the mentally ill and addicts to be operated by the same people who have clinical practices, but they separate the housing out as a separate business. Because there's overlap though, say the residence providing behavioral updates to the clinical team or the clinical team disclosing diagnoses or other concerns to the housing team, HIPAA still applies to those employees charged solely with monitoring the residences and having zero clinical credentials or involvement in the client's care. A recent case at my clinic was a housing monitor employee overheard something medical about Client A and disclosed it to Client's B, C, and D. Even though the housing monitor technically plays zero medical or mental health role in that client's treatment, they are still being investigated for HIPAA violations for disclosing and sharing that information.

I think he's "released from custody" in name only. Released from JAIL custody, but probably into the "custody" of some other group or individual. There's no way he wouldn't have found his way to a phone, library computer, etc. by now otherwise. My assumption is that he's probably heavily medicated in some type of supervised location.
