Short Answer: it depends.

Longer answer: if Alice can be corralled by the State of California into lending assistance, possibly.

Longerer answer: it really doesn't matter because it is highly unlikely that this will go to trial. Ralph will almost certainly plea out when the rubber hits the road, so the potential admissibility of text messages is more useful in the form leverage for negotiation than as actual evidence. One of the elements that the state is required to prove is that the violation of the protection order was "willful," which the prosecutor could prove anyways without this smoking gun evidence, but that element is where Ralph would likely put up the most fight in a theoretical trial. The threat of potentially introducing the texts at trial is an arrow in the quiver of a prosecutor to force a more favorable plea agreement.

I still don't buy it, it's a far strech to think that the Californian Prosecutor would convince some BPD retard from Virginia to admit that indeed those text were between her an Ralph. If I would be in Ralph place and prosecutor would bring the Alice DM's up I would laugh him out.

Just reading into this a bit, this is unlike the recordings that Faith could not use in court because 2 Party consent laws come into play during the recording of phone calls because it falls under the same laws as wiretapping. Apparently, and I would like to highlight I am not a legal expert nor am I American so forgive me if this is not 100% accurate, leaking DMs does not fall under the same legislation. It is more akin to whether someone had a right to access the logs held on a given computer at the time the logs were released - they were stored on Alice's phone so she has the right to access those texts.

I have no idea as to whether Alice would even need to be involved voluntarily, surely if CA wanted to they could just subpoena those messages?
Fuck, they could subpoena their phone providers, or even Ralph right?

This is all hypothetical, assuming that Vickers isn't just talking garbage or that CA wont just drop it because they don't care. Assuming there is something and they do care, there is reasonable grounds to search those messages on those devices to prove they are real if CA was so inclined.

You're still thinking of this in the context of there being a trial. There almost certainly won't be. An improbable threat is still a threat, and that factors into how a plea agreement may ultimately be negotiated. Will the State of California ever get Alice involved to testify to authenticate those texts? Almost certainly not. Will they still try to use the texts' existence as leverage? Probably. Will they succeed? Maybe. Will this affect the outcome? No. Ralph's guilty as fuck—it's just a matter of how we get there, and if the State cares enough to prosecute this.

Ok, still seems extremely retarded to me, but maybe it's more because of the fact the the whole Ralph situation is absurd and it's hard for me to imagine being in the place that Ralph is right know.

Also, the whole active fucking with Ralph by Vickers seems very weird to me. It's like he is mad that somebody else then him raped his daughter.
